<br /> 138 <br /> RESOLUTION NO. 1989- 13 9R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS APPROVING THE TERMS AND <br /> CONDITIONS OF AMENDMENT NUMBER ONE TO THE <br /> COMMUNITY DEVELOPMENT PROGRAM CONTRACT NUMBER <br /> 707202 BETWEEN THE CITY AND THE TEXAS <br /> DEPARTMENT OF COMMERCE; AUTHORIZING THE MAYOR <br /> TO EXECUTE THE AMENDMENT ON BEHALF OF THE <br /> CITY; AND DECLARING AN EFFECTIVE DATE. <br /> WHEREAS, the City executed Community Development Program <br /> Contract No. 707202 with the Texas Department of Commerce (TDoC) <br /> dated December 15, 1988; and, <br /> WHEREAS, TDoC has requested an amendment to this Contract for <br /> the purpose of substituting an amended Performance Statement for <br /> that attached to the original contract as Exhibit A; and, <br /> WHEREAS, the City Council finds the proposed amendment to be <br /> necessary and appropriate, and in the interest of the citizens of <br /> San Marcos; now, therefore <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the terms and conditions of the Amendment No. 1 <br /> to Community Development Program Contract No. 707202 between the <br /> City and TDoC are hereby approved. <br /> PART 2. That the Mayor, Kathy M. Morris be, and she is <br /> hereby authorized to execute the above-described amendment on <br /> behalf of the City. <br /> PART 3.
