Taylo~ <br /> City Attorney <br /> SUBJECT: Property Acquisitions in Connection with Soil <br /> Conservation Service (SCS) Sponsored Park Improvements <br /> DATE: <br /> November 9, 1989 <br /> You have requested my opinion regarding the adequacy of title, <br /> right, permission and authority of real property acquisitions by <br /> the City in connection with the pending park improvement project <br /> sponsored by the SCS. <br /> The City of San Marcos obtained two authorizations in connection <br /> with 'this project, one in the form of a Multiple Use Agreement <br /> with the State of Texas and the other in the form of a Temporary <br /> Construction Easement from the Nature Conservancy of Texas, Inc. <br /> The Multiple Use Agreement covers a 0.370 acre area of State <br /> right-of-way for the U.S. Interregional Highway 35. It was <br /> approved by the Federal Highway Administration on May 8, 1989 and <br /> was executed on June 27, 1989. This agreement authorizes the <br /> construction of an access road within State right-of-way. An <br /> original copy 0 f the agreement is on file in the office of the <br /> City Secretary. <br /> The Temporary Construction easement covers a 100 foot wide area <br /> between a public street and a tract of property under prior <br /> ownership by the City. This instrument was executed on August 14, <br /> 1989, and has been filed for record in the Real Property Records <br /> of Hays County, Texas. <br /> In my opinion, these two instruments provide adequate title, <br /> right, permission and authority for the purposes for which the <br /> property rights were acquired. <br /> MBT/jvr <br />
