<br /> AMENDMENT NO. 1 TO CONSOLIDATION AND AMENDMENT <br /> OF LEASES DATED AUGUST 30, 1989, BETWEEN <br /> THE CITY OF SAN MARCOS AND AVPRO, INC. <br /> STATE OF TEXAS <br /> KNOW ALL PERSONS BY THESE PRESENTS: <br /> :OUNTIES OF HAYS AND CALDWELL <br /> WHEREAS, the City of San Marcos, Texas, a municipal Corporation <br /> (the "Lessor") and AVPRO, Inc., a Texas corporation d/b/a Aviation <br /> Professionals, Inc. (the "Lessee") entered into an agreement dated <br /> August 30, 1989 (the "Lease") under which Lessor leased to Lessee <br /> certain areas at Lessor's Municipal Airport Facility for use by Lessee <br /> as a fixed base operator ("FBO") at the Airport Facility; and, <br /> WHEREAS, the Lease provided for lease by the Lessor to the Lessee <br /> of an area of approximately 700 square feet in a new terminal building <br /> being constructed by Lessor at the Airport Facility; and, <br /> WHEREAS, the Lessee has requested an amendment to the Lease in <br /> ~rder to add an additional lease area within the new terminal building <br /> )f approximately 900 square feet making the total lease area within the <br /> new terminal building approximately 1,600 square feet; and, <br /> WHEREAS, the Airport Commission has recommended the approval of <br /> the requested amendment subject to the terms and conditions contained <br /> in this document. <br /> NOW, THEREFORE, in consideration of the mutual agreements <br /> contained in this Lease Amendment No. I, the Lessor and the Lessee do <br /> hereby agree to an amendment of the lease as follows: <br />
