<br />AN ORDHiANCE OF THF: CITY COPNCIf, OF THF: CITY OF SAN
<br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOL. 66) BY CHANGING THE ZONING OF LOT A OF SIMPSON'S
<br />REARRANGEMENT OF LOTS 21, 26, 35, AND 40 OF THE A. M.
<br />RAMSEY SUBDIVISION, HAYS COUNTY, TEXAS, AS RECORDED IN
<br />VOLUME 2, PAGE 206 OF THE HAYS COUNTY PLAT RECORDS, A/K/A
<br />409 MILL STREET FROM "M" (SINGLE-FAMILY, DUPLEX AND
<br />NEIGHBORHOOD BUSINESS DISTRICT) TO "DP-2" (TWO FAMILY
<br />DWELLING DISTRICT) (MEDIUM DENSITY); AND DECLARING AN
<br />EFFECTIVE DATE.

<br />WHEREAS, on July 18, 1989, the Zoning Commission of the City of
<br />San Marcos held a public hearing regarding a request to change the
<br />zoning from "M" (Single-Family, Duplex and Neighborhood Business)
<br />District to "DP-2" (Two Family Dwelling District) of Lot A, of
<br />Simpson's Rearrangement of Lots 21, 26, 35 and 40 of the A.M. Ramsey
<br />Subdivision, to the City of San Marcos, Hays County, Texas; and,
<br />
<br />WHEREAS, subsequent to the public hearing on that date, the
<br />Commission did, on July 18,1989, consider the request and vote to
<br />approve it and has recommended that the request be approved by the
<br />City Council; and,
<br />
<br />WHEREAS, the City Council held a public hearing on the II day
<br />of December, 1989, regarding the request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, the City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "M" (Single-Family, Duplex, and Neighborhood Business
<br />District) be rezoned "DP" (Two Family Dwelling District) (Medium
<br />Densi ty) :

<br />LOT A OF SIMPSON'S REARRANGEMENT OF LOTS 21, 26, 35, AND 40
<br />OF THE A. M. RAMSEY SUBDIVISION, HAYS COUNTY, TEXAS, AS
<br />RECORDED IN VOLUME 2, PAGE 206 OF THE HAYS COUNTY PLAT RECORDS.
<br />
<br />SECTION 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on January 8, 1990, it shaÍl be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be published in a newspaper ot general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.

<br />PASSED, APPROVED AND ADOPTED this the II day of December, 1989 ,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for January 8, 1990 .
