<br /> 163 <br /> OÞTìTNJ\NCl~ 1989- TO <br /> ---. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> ~.1ARCOS, TEXAS, PROVIDING FOR THE TAXATION OF FREEPORT <br /> PROPERTY OTHERWISE EXEMPT FROM TAXATION UNDER ARTICLE <br /> VIII, SECTION l-J OF THE STATE CONSTITUTION; DECLARING <br /> AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. <br /> WHEREAS, Article VIII, Section 1-j of the Texas Constitution <br /> incorporates a recent amendment creating an exemption from ad valorem <br /> taxation of certain personal property that is temporarily in the State <br /> for manufacturing purposes ("freeport property"); and, <br /> WHEREAS, the City Council finds that the continued taxation of <br /> freeport property is in the interest of the citizens of the City; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. That all of the property described in Article VIII, <br /> Section 1-j of the Texas Constitution shall be fully taxable in the <br /> City of San ~1arcos, beginning January 1, 1990, and thereafter. <br /> SECTION 2. That all ordinances and parts of ordinances in <br /> conflict herewi th are hereby repealed to the extent of the conflict. <br /> SECTION 3. That, due to the need to take final action prior to <br /> January 1, 1990 in 0 rd e r to implement the continued taxation of <br /> freeport property in 1990, an emergency is hereby declared, so that <br /> the provisions of the Charter requiring that ordinances shall be <br /> presented at three separate meetings and that no ordinance shall become <br /> effective until the expiration of ten (l 0) days following the date of <br /> its final passage be suspended, and these provisions are hereby <br /> suspended, and this Ordinance shall take effect and be in full force <br /> and effect from and after its adoption and after its publication in a <br /> newspaper of general circulation within the City as provided by the <br /> City Charter of the City of San Marcos. <br /> PASSED, APPROVED AND ADOPTED th\~~~~ñthber , <br /> 1989. <br /> ~t: ::J!; V' Mayor <br /> ~) ,~¡}~~~JJ <br /> J is K. vJomack <br /> City Secretary <br /> Approved: <br /> ~ð.~ <br /> Mark B.
