<br />166 <br /> <br /> <br />STATE OF TEXAS <br />REIMBURSEMENT AGREEMENT FOR <br />WASTEWATER IMPROVEMENTS <br />COUNTY OF HAYS <br /> <br />KNOW ALL PERSONS BY THESE PRESENTS: <br />That this Agree~ent is made and entered into on this ~ day of <br />December , 1989 ,by and between the City of San Marcos, a <br />municipal corporation organized under the laws of the State of Texas <br />("City") and Composite Technology Engine Components, limited <br />partnership ("CTEC" ), for the purposes and consideration hereinafter <br />described: <br />RECITALS <br />Whereas, the Subdivision Ordinance of the City provides for the <br />installation of certain public improvements, including an allocation of <br />the cost of such improvements; and, <br />Whereas, the City desires to have certain wastewater lines to be <br />constructed by CTEC oversized in accordance with the Subdivision <br />Ordinance of the City; and, <br />Whereas, CTEC is willing to participate with the City in the <br />construction of these lines; and, <br />Whereas, the City, through its Public Works Department, has <br />required the construction of sewer lines of a size greater than is <br />required to adequately serve the San Marcos Technology Park <br />Subdivision; <br />Now, therefore, the City and CTEC, in consideration of the mutual <br />promises, covenants and agreements set forth herein expressly agree and <br />contract as follows: <br />1. CTEC agrees to construct improvements to the City's wastewater <br />system in the form of an eight (8) inch diameter gravity flow, lift <br />station, and four (4) inch diameter force-main wastewater main from San <br />Marcos Technology Park Subdivision, down and parallel to the East <br />right-of-way line of Northeast Interstate Highway 35 to the existing <br />fifteen (15) inch diameter city sanitary sewerline, as described on <br />Exhibit "A" attached hereto and made a part hereof for all purposes. <br />2. CTEC agrees that these wastewater improvements will be <br />constructed according to city specifications as determined by the <br />Director of Public Works of the City of San Marcos. <br />3. CTEC and the City agree that CTEC will act as Project Manager <br />in the construction of these improvements. <br />
