<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />HARCOS, TEXAS, TERHINATING REINVESTMENT ZONE NUHBER
<br />ONE, CITY OF SAN MARCOS, TEXAS, AND OTHER MATTERS
<br />RELATING THERETO.

<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas (the
<br />"City"), through the adoption of Ordinance 1983-80 on December 29,
<br />1983, created Reinvestment Zone Number one, City of San Marcos, Texas
<br />(the "Zone") , encompassing the 121.43 acre tract of real property in
<br />Hays County, Texas described on the attached Exhibit "A", established a
<br />Board of Directors for the Zone and determined other matters related
<br />thereto, as authorized by the Texas Tax Increment Financing Art of 1981
<br />as amended, codified as Article 1066e, Vernon's Texas Civil Statutes,
<br />now Section 311 et. seq. Texas Tax Code (the "Act"); and
<br />
<br />WHEREAS, Ordinance No. 1983-80 was amended by two ordinances
<br />adopted February 16, 1984, by the City of San Marcos, Texas; and,
<br />
<br />WHEREAS, all plans for the construction of improvements pursuant
<br />to the Project Plan adopted by the Board of Directors for the Zone have
<br />been abandoned; and,
<br />
<br />WHEREAS, all owners of property located within the Zone have
<br />requested that the Zöne be terminated pursuant to the Texas Tax
<br />Increment Financing Act, Section 311.0l7(a)(I), Texas Tax Code.

<br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
<br />SAN MARCOS:
<br />
<br />SECTION 1. That the facts and recitations contained in the
<br />preamble of this ordinance are hereby found and declared to be true and
<br />correct.
<br />
<br />SECTION 2. That the City hereby terminates the operation of
<br />Reinvestment Zone Number One, City of San Marcos, Texas encompassing
<br />the 121.43 acre tract of real property in Hays County, Texas, described
<br />on the attached Exhibit "A", effective on the effective date of this
<br />ordinance.

<br />SECTION 3. That the City Manager, Larry D. Gilley, is hereby
<br />authorized and directed to give written notice of the termination of
<br />the zone to each taxing unit which levies property taxes within the
<br />Zone.
<br />
<br />SECTION 4. That it is hereby found, determined and declared that
<br />a sufficient written notice of the date, hour, place and subject of the
<br />meeting of the City Council at which this ordinance was adopted was
<br />posted at a place convenient and readily accessible at all times to the
<br />general public at the City Hall of the City for the time required by
<br />law preceding this meeting, as required by the Open Meetings Law,
<br />Article 6252-17, Vernon's Texas Civil Statutes, as amended, and that
<br />this meeting has been open to the public as required by law at all
<br />times during which this Ordinance and the subject mattter hereof has
<br />been discussed, considered and formally acted upon. The City Council
<br />further ratifies, approves and confirms such written notice and
<br />contents and posting thereof.
