1'73 RRc;OLUTION NO. 1989-1;tiLß A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A ~vATER FACILITIES AGREEMENT BETWEEN THE CITY AND THE PRH1E GROUP, INC.; AND DECLARING AN EFFECTIVE DATE. WHEREAS, The Prime Group, Inc. ("Prime") has submitted to the City for approval a subdivision of a 55.077 acre tract of land (the "Subdivision") at the Northeast corner of the intersection of Interstate Highway 35 and Center Point Road; and, WHEREAS, applicable ordinances of the City pertaining to subdivision development require the construction of water distribution facilities conforming to City construction design standards and adequate for fire protection purposes; and, WHEREAS, Prime has requested approval of the city for filing the plat of the Subdivision in advance of construction and completion of the required water distribution facilities throughout the Subdivision; and, WHEREAS, the Planning Commission of the City has given its approval to this request by Prime, subject to Prime executing an agreement wi th the City ensuring that any construction of Itlater distribution facilities will be completed in conformance with the water service and fire protection requirements of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of the Water Facilities Agreement attached hereto as Exhibit A between the City and Prime are hereby approved. PART 2. That the City Manager, Larry D. Gilley, is hereby authorized to execute the Water Facilities Agreement on behalf of the City. PART 3. That this Resolution shall be in full force and effect from and after its passage.
