<br />
<br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br />MARCOS,TEXAS, ABANDONING AND VACATNG A 1,297.5 SQUARE
<br />FOOT ALLEY, AND BEING THAT ALLEY WHICH ABUTS LOTS 4,5,
<br />AND 6, BLOCK 6 OF THE ORIGINAL TOWN OF SAN MARCOS, TEXAS;
<br />AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE A SPECIAL
<br />WARRANTY DEED; REFLECTING PAYMENT OF THE FAIR MARKET
<br />VALUE OF $975.00; AND DECLARING AN EFFECTIVE DATE.
<br />
<br />WHEREAS, the City of San Marcos owns an interest in an alley
<br />reserved for public use, the same being an alley containing 1,297.5
<br />square feet in its entirety, said alley abutting Lots 4,5 and 6,
<br />Block 6 of the Original Town of San Marcos, Texas, the plat of said
<br />addition originally recorded in Volume 46, Page 448, Hays County Deed
<br />Records, now filed in Volume 1, Page 20 of the Hays County Plat
<br />Records; and,
<br />
<br />WHEREAS, the
<br />Mae King to abandon
<br />
<br />City of San Marcos has been
<br />said alley; and,
<br />
<br />requested by
<br />
<br />Lotha
<br />
<br />WHEREAS, the City of San Marcos has duly determined that Lotha
<br />Mae King, is the sole owner of all property abutting said alley
<br />within said Original Town of San Marcos; and,
<br />
<br />WHEREAS, the City Council of the City of San Marcos, Texas, has
<br />determined that it is in the public interest to abandon said portion of
<br />såid alley; and,
<br />
<br />WHEREAS, the said Lotha Mae King has executed a
<br />discharging said City from any damages occasioned by said
<br />and abandonment; and,
<br />
<br />re lease,
<br />vacation
<br />
<br />WHEREAS, the City of San Marcos ~as determined by appraisal that
<br />the fair market value of said property is $975.00 and the same has
<br />previously been deposited with said City; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY

<br />SECTION 1. That an alley containing 1,297.5 square feet in
<br />entirety, and being that alley which abuts Lots 4,5 and 6, Block 6
<br />of the Original Town of San Marcos, Texas, the plat of said
<br />property originally recorded in Volume 46, Page 448, Deed Records of
<br />Hays County, Texas, now filed in Volume 1, Page 20 of the Hays County
<br />Plat Records be, and it is hereby declared to be, and is henceforth,
<br />vacated and abandoned as to any use, right, claim in, or responsibility
<br />for the upkeep and maintenance by the public in general and the
<br />City of San Marcos in particular.
<br />
<br />SECTION 2. That the Mayor of the City of San Marcos, Texas, be,
<br />and he is hereby, authorized to execute a special warranty
<br />deed conveying to Lotha Mae King, said alley which abuts her
<br />property.
<br />
<br />SECTION 3. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage, and it shall be published in a newspaper of
<br />general circulation in the area as required by the Charter of the City
<br />of San Marcos, Texas.
