<br />121 <br /> <br />RESOLUTION 1988-60R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING A PROPERTY TAX REFUND BY THE <br />TAX-ASSESSOR IN THE AMOUNT OF $2,121.63 AND INTEREST <br />THEREON IN THE AMOUNT OF $106.10 OF PROPERTY TAXES ON <br />REAL PROPERTY GENERALLY DESCRI BED AS 2.86 ACRES I N THE <br />J.M. VERAMENDI SURVEY, ABSTRACT 17-2 IN SAID CITY, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, pursuant to V.T.C.A., TAX CODE, § 42.01, Ye Olde Colony <br />84, Ltd. appealed the order of the Hays County Appraisal Review Board <br />determining a protest on the ground of unequal appraisal of real <br />property in the City of San Marcos~ and, <br /> <br />WHEREAS, an Agreed Judgment in Cause No. 86-0808 was <br />presiding judge of the 274th Judicial District Court of <br />Texas, on October 7,1987, which resulted in a reduction <br />value of the land and improvements generally described as <br />the J.M. Veramendi Survey, Abstract l7-2~ and, <br /> <br />signed by the <br />Hays Coun ty , <br />of the market <br />2.86 acres in <br /> <br />WHEREAS, no appeal was taken from the said judgment entered on <br />October 7, 1987 within 30 days thereafter as required by law for <br />filing of notice of appeals; and, <br /> <br />WHEREAS, said judgment <br /> <br />became <br /> <br />final on <br /> <br />November 7, <br /> <br />1987~ <br /> <br />and, <br /> <br />WHEREAS, V.T.C.A., TAX CODE, § 31.12 requires payment of interest <br />at the rate of 1% for each month or part of a month that a refund <br />remains unpaid after the expiration of 60 days following the date the <br />liability for same arises~ now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY <br />TEXAS: <br /> <br />COUNCI L OF <br /> <br />THE <br /> <br />CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />PART 1. That the Tax-Assessor is hereby <br />property taxes previously paid on real property <br />2.86 acres in the J.M. Veramendi Survey, <br />Account No. 10-0017-2218-00000-3, in the <br />to the property owner(s). <br /> <br />authorized to refund <br />generally described as <br />Abstract No. 17-2, Tax <br />amount of $2,121.63 <br /> <br />PART 2. That, pursuant to V.T.C.A., TAX CODE, § 31.12, interest on <br />the amount of the refund set forth in Part 1 above in the amount of <br />$106.10 is hereby authorized to be paid to such property owner(s). <br /> <br />PART 3.
