<br /> <br /> <br />185 <br /> <br />ORDINANCE 1988-56 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING CHAPTER 12 OF THE SAN MARCOS <br />CODE OF ORDINANCES BY THE ADDITION OF A REQUIREMENT FOR <br />GARBAGE CONTAINERS OR PRIVATE GARBAGE SERVICE IN ALL <br />MULTIFAMILY BUILDINGS HAVING FOUR (4) OR MORE UNITS; <br />ALLOWING SIXTY (60) DAYS FOR COMPLIANCE BY EXISTING <br />MULTI-FAMILY UNITS; AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br /> <br />SAN <br /> <br />MARCOS, <br /> <br />TEXAS: <br /> <br />PART 1. That a Section 12-16 be added to Chapter 12 of the San <br />Marcos Code of Ordinances as follows: <br /> <br />Sec. 12-16. <br /> <br />Containers or private garbage service required. <br /> <br />a. All owners of multifamily buildings with more than four <br />(4) dwelling units shall furnish and maintain garbage <br />containers suitable for pick up by the City's garbage <br />service as determined by the City or provide through <br />written contract, a copy of which shall be supplied to City <br />upon request, for garbage collection services for said <br />multifamily buildings not less frequently than once per <br />week. <br /> <br />b. In the case of condominium projects with more <br />(4) dwelling units, the condominium association <br />responsible for compliance with this section. <br /> <br />than four <br />shall be <br /> <br />c. In the case of townhouse projects of four or more <br />contiguous units where garbage service cannot be suitably <br />provided through the City, each owner must provide for <br />garbage collection services through written contract, a copy of <br />which shall be supplied to City upon request. Such contracts <br />may be entered into by multiple townhouse owners togethèr or <br />individually. <br /> <br />d. In determining the suitability of providing garbage <br />service at a particular location under this section, <br />the City shall consider the following: <br /> <br />(I) any adverse impact on the flow of traffic; <br /> <br />(2) any traffic hazard <br />location of garbage <br /> <br />that might result from <br />which is to be picked up; <br /> <br />the <br /> <br />(3) any adverse impact on <br />and, <br /> <br />public <br /> <br />health or <br /> <br />sanitation; <br /> <br />(4) any other requirements of Chapter 12 of <br />which may be applicable. <br /> <br />this <br /> <br />Code <br /> <br />PART 2. That the owners of existing multifamily buildings <br />which have been issued certificates of occupancy on or <br />before the effective date of this ordinance shall have sixty (60) days <br />from the effective date hereof to comply with new Section 12-16. <br /> <br />PART 3.
