RESOLUTION N0.2013 -1618 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />AUTHORIZING THE DONATION OF A SURPLUS FIRE TRUCK TO PINK HEALS <br />HAYS COUNTY; FINDING THAT SUCH CONVEYANCE SERVES THE PUBLIC <br />PURPOSES OF PUBLIC HEALTH EDUCATION BY PROMOTING CANCER <br />AWARENESS AND IMPROVING PUBLIC HEALTH BY PROVIDING FUNDING FOR <br />CANCER TREATMENT FOR THE CITIZENS IN THE CITY OF SAN MARCOS, CITY <br />OF SAN MARCOS EMPLOYEES, AND HAYS COUNTY; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE A CONTRACT AND ANY AND ALL DOCUMENTS AS <br />NECESSARY TO TRANSFER TITLE AND CONVEY THE FIRE TRUCK TO PINK <br />HEALS; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The City of San Marcos Fire Department owns a fire truck that has reached the end of its <br />useful life, is functionally obsolete for fire - fighting purposes and is hereby declared surplus <br />equipment; and <br />2. Pink Heals Hays County is a tax - exempt non - profit organization whose mission is to help <br />women battling cancer by providing funds for treatment and promoting cancer awareness. This <br />organization's theme is Public Safety using pink fire trucks and pink police cars to assist in its <br />mission. <br />3. Pink Heals Hays County, a nonprofit organization, is in need of a fire truck in order to <br />assist its efforts to promote cancer awareness and fundraising in the City of San Marcos and <br />Hays County communities through its local chapter. Pink Heals Hays County donates 100% of <br />the money raised back to the public in the local communities either by way of local charity or <br />actual people in need of help to defer their cost for cancer treatment. The "Pink Heals" tour aims <br />to help local communities raise money to help those affected by cancer in their own towns. <br />3. City of San Marcos employees as well as residents of the City of San Marcos have been <br />past recipients of funds from the Pink Heals organization for cancer treatment. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Findings. All of the above Recitals are hereby found to be true and <br />correct findings of the City Council of San Marcos, and are hereby approved and incorporated <br />into the body of this Resolution as if copied in their entirely. <br />SECTION 2. The City Council hereby finds that the conveyance of the surplus fire truck <br />to Pink Heals fulfills the the public purposes of providing public health education regarding <br />
