<br />156. <br /> <br />RESOLUTION 2005- 154 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, TERMINATING A CONTRACT WITH PHILPOTT MOTOR <br />COMPANY FOR THE PURCHASE OF TWO 2005 FORD FREESTAR <br />MINIVANS FOR THE WIC PROGRAM THROUGH THE HOUSTON- <br />GALVESTON AREA COUNCIL OF GOVERNMENTS COOPERATIVE <br />PURCHASING PROGRAM; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. On August 1, 2005 the City approved a contract with Philpott Motor <br />Company (the "Vendor") for the purchase of two 2005 Ford Freestar minivans for the WIC <br />Program through the Houston-Galveston Area Council ("HGAC") of Governments <br />Cooperative Purchasing Program in the amount of $38,717.00 (the "Contract"). <br /> <br />2. After placing the order, the City was notified that the Vendor was unable to <br />deliver the minivans prior to the close of the 2005 fiscal year. <br /> <br />3. Because the purchase would be moved into the 2006 fiscal year, the WIC <br />Program would forfeit the 2005 fiscal year surplus State funding with which to buy the <br />minivans. <br /> <br />4. Due to the lack of available surplus funding, the WIC Program is unable to <br />purchase the minivans and must terminate its contract with the Vendor. <br /> <br />5. Both the City and the Vendor agree to terminate this Contract. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The Contract with the Vendor for the purchase of two 2005 Ford <br />Freestar minivans for the WIC Program is terminated. <br /> <br />PART 2. The Purchasing Manager, Cheryl Pantermuehl, is authorized and <br />directed to provide notice of the termination of the Contract to the Vendor. <br /> <br />PART 3. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br /> <br />ADOPTED this the 18th day of October, <br /> <br />2005. <br /> <br />~h <br /> <br />Mayor <br />
