On July 27, 2004, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the zoning from "P" Pubic and Instltutional <br />District to "LB" Limited Business District for a 0.213 acre tract of property located at 329 North <br />Street, with a concurrent revision to the Future Land Use Plan. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />did, on July 27, 2004 consider and vote to approve the request, and has recommended that the <br />request be approved by the City Council of the City. <br /> <br />I <br /> <br />3. The City Council held a public hearing on the 20 day of September <br />2004, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining to <br />zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to rezone the following real property which is presently <br />zoned "P" Public and Institutional District to "LB" Limited Business District: <br /> <br />Street address: 329 North Street. <br /> <br />Size: 0.213 acres. <br /> <br />1 <br /> <br />Legal description: Part of Block 13 of the Lindsey and Harvey Addition, a metes and <br />bounds description of which is attached as Exhibit A. <br />
