<br /> 48 <br /> RESOLUTION 1986-58R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AUTHORIZING THE CITY <br /> ATTORNEY TO PURSUE UNPAID CLAIMS OF THE CITY <br /> BY FILING PROOFS OF CLAIM IN PENDING <br /> BANKRUPTCY PROCEEDINGS AND/OR TAKING All OTHER <br /> ACTION NECESSARY TO THE PURSUIT AND/OR <br /> lITIGATION OF SAID CLAIMS BY THE CITY <br /> ATTORNEY'S OFFICE, AND DECLARING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, the City of San Marcos, Texas, frequently has valid <br /> claims against debtors in bankruptcy for unpaid sales taxes and/or <br /> utilities: and, <br /> WHEREAS, in order to collect such unpaid amounts, it is <br /> necessary that claims be asserted in the U.S. Bankruptcy Courts; <br /> now, therefore: <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the City Attorney is hereby authorized. to <br /> pursue unpaid claims of said City against debtors in bankruptcy by <br /> filing proofs of claim in pending bankruptcy proceedings ana/or by <br /> taking all other action necessary to the pursuit and/or litigation <br /> of said claims by the City Attorney's Office. <br /> PART 2.
