<br />AND DECLARING AN EFFæTIVE DATE.

<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />~ílHEREAS, on March 4, 1986, the Zonil1ÇJ Commission of the City of
<br />San Marcos held a public hearing regardil1ÇJ a request to change the
<br />zoning from "PD" (Pre-Developrent District) to "c" (Comrœrcial
<br />District) of 2.98 acres of land, more or less, out of the J.M.
<br />Veramend i Survey, A-17 , San Marcos, Hays County, Texas: and,
<br />
<br />vílHEREAS, subsequent to said public hearil1ÇJ on said date, said
<br />Commiss ion did, on March 4, 1986, consider said request and
<br />voted to approve the same and has recomrœnded that such request be
<br />approved by the City Council of said City: and,
<br />
<br />WHEREAS, said City Council held a public hearil1ÇJ on the 23 day
<br />of June , 1986, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the Ci ty of San Marcos
<br />pertaining to amendments have been met: and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the followil1ÇJ ordinance is in the interest of the public
<br />health, morals, welfare and safety: now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:

<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which was classified
<br />"PD" (Pre-Developrent District) upon its annexation to the City of San
<br />Marcos on November 24, 1980, henceforth shall be zoned as "CII
<br />(Comrœrcial District):

<br />DEOCRIPTION OF 2.98 ACRES, MORE OR LESS, OF LAND AREA IN THE
<br />J .M. VERAMENDI SJRVEY, A-17 HAYS COUNTY, TEXAS BEING ALL OF
<br />THOSE THREE TRACTS DESCRIBED IN A DEED FROM L. D. BROVVN ET OX 10
<br />ANSELMO CDNZALEZ ET UX DATED AUGUST 17, 1977 AS RECORDED
<br />IN VOLUME 299, PAGE 697, OF THE HAYS COUNTI DEED RECORDS, AND
<br />BEING MORE PARTICULARLY DESCRIBED BY METES AND roUNDS AS
<br />FOLLOWS:

<br />BEGINNING at a half inch alwninum capped iron rod set inscribed
<br />"Byrn & Associates, Inc." for the \Nest corner of this tract, the
<br />west corner of the Gonzalez Tract 3, the south corner of San-Mar
<br />Plaza as recorded in Volume 2, Page 242 of the Hays County Plat
<br />Records, and in the north right-of-way line of State Highway No.
<br />80 fram which a 5/8 inch iron rod found bears S44° 37'39"W 0.45
<br />feet:

<br />THENCE leaving the PLACE OF BEGINNING and State Highway No. 80
<br />as shown on that plat numbered 22095-86-c dated April 24, 1986
<br />as prepared for Anselmo Gonzalez by Byrn & A.ssociates, Inc. of
<br />San Marcos, Texas with the cormnon line of the Gonzalez Tract 3
<br />and San-Mar Plaza N44 °37'39"E 608.00 feet to a half inch
<br />alurninwn capped iron rod found inscribed "Pro-Tech" for north
<br />corner of this tract, the north corner of the Gonzalez Tract 3,
<br />and the most westerly corner of that tract described as 18.14
<br />acres in a deed fram Murray Harper to George Dolezal et al dated
<br />February 1, 1984 as recorded in Volume 417, Page 233 of the Hays
<br />County Real Property Records;
