<br /> AN ORDINANCE OF THE CIT'( COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF LOT 1 OF THE SUMI'1 I T ADDITION
<br /> TO THE CITY OF SAN t1ARCOS, HAYS COUNTY, TEXAS, A
<br /> SUBDIVISION IN THE CITY OF SAN MARCOS AS SHOWN ON THE
<br /> AMEND{¡ ORY MAP OR PLAT THEREOF RECORDED IN VOLUME 3, PAGE
<br /> 117, OF THE HAYS COUNTY PLAT RECORDS; AI KIA 1348 THORP
<br /> LANE FROM "M" (SINGLE, DUPLEX AND NEIGHBORHOOD BUSINESSES
<br /> DISTRICT) TO "MF-5" (MULTI-FAMILY DISTRICT); AND DECLARING
<br /> AN EFFECTIVE DATE.
<br /> WHEREAS, on June 3, 1986, the Zoning Commission of the City of
<br />San Marcos held a publ ic hearing regarding a request to change the
<br />zon i ng from "M" (Single, Duplex and Neighborhood Businesses
<br />District> to "MF-5" (Multi-Family District:> of Lot 1 of the Summ i t
<br />Addition, San Marcos, Hays County, Texas; and,
<br /> WHEREAS, subsequent to said pub1 ic hearing on said date, said
<br />Commission did, on June 3, 1986, consider said r.equest and
<br />voted to approve the same and has recommended that such request be
<br />approved by the Ci ty Council of said C i t y; an d,
<br /> WHEREAS, said City Council held a pub1 ic hearing on the 14 day
<br />of July , 1986, regarding such request; and,
<br /> WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the Ci ty of San Marcos
<br />pertaining to amendments have been met; and,
<br /> WHEREAS, said Ci ty Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the publ ic
<br />health, morals, welfare and safety; now, therefore,
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECTI ON 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently zoned
<br />"M" (Single, Duplex and Neighborhood Businesses District) henceforth
<br />shall be rezoned "MF-5" (Multi-Family District):
<br /> LOT 1 OF THE SUMMIT ADD IT I ON TO IHL CITY OF SAN MARCOS,
<br /> HAYS COUNTY, TEXAS, A SUBDIVISION IN THE CITY OF SAN t1ARCOS
<br /> AS SHOWN ON THE AMENDATORY MAP OR PLAT THEREOF RECORDED IN
<br /> VOLUME 3, PAGE 117, OF THE HAYS COUNTY PLAT RECORDS.
<br /> SECTI ON 2. That this Ordinance shall be in effect ten (10) days
<br />from and after its passage and after it has been subject to
<br />reconsideration by the Council at its next regular meeting following
<br />its passage, and providing that the Council did not vote to reconsider
<br />it. If reconsidered on July 28, 1986 it shall be in effect ten
<br />days from and after its passage on that date if approved. It shall not
<br />go into effect if denied. If not reconsidered or if reconsidered and
<br />approved it shall be publ ished in a newspaper of general circulation in
<br />the area as required by the Charter of the City of San Marcos, Texas.
<br />PASSED, APPROVED AND ADOPTED this the 14 day of July 1986 ,
<br />subject to reconsideration at the next regular City Council meeting
<br />scheduled for July 28, 1986 .
