<br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN
<br /> MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH
<br /> REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br /> STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br /> CHANGING THE ZONING OF LOTS 11, 12, 13 AND 14 OF THE
<br /> B.G. COLLIER SUBDIVISION, SAN 1'-1ARCOS, HAYS COUNTY,
<br /> TEXAS, A PORTION OF THE J .M. VERAMEND I SUR~.JEY, HAYS
<br /> COUNTY, TE.,'(AS, AS RECORDED IN VOLUME 108, PAGE 34, OF
<br /> THE HAYS COUNTY DEED RECORDS pND LOCATED NORTH OF SPRING
<br /> ROAD AND ON POST ROAD FROM "M" (SINGLE, DUPLEX AND
<br /> NEIGHBORHOOD BUSINESSES DISTRICT) TO "MF-3" (MULTI-FAMILY
<br /> DISTRICT); AND DECLARING AN EFFECTIVE DATE.
<br /> l<JHEREAS, on May 6, 1986, the Zoning Commission of the City of
<br /> San Marcos held a publ ic hearing regarding a request to change the
<br /> zoning from "1'1" (Single, Duplex, and Neighborhood Businesses
<br /> District) to "MF-4" (Mu 1 t i -Fam i 1 'I District) of Lots 11, 12, 13
<br /> and 14 of the B.G. Coll ier Subdivision, San Marcos, Hays County,
<br /> Texas; and,
<br /> WHEREAS, subsequent to said publ ic hearing on said date, said
<br /> Commission did, on May 6, 1986, consider said request and
<br /> voted to deny the same but recommended that a zoning change to MF-3
<br /> request be approved by the Ci ty Council of said Ci ty; and,
<br /> WHEREAS, said City Council held a publ ic hearing on the 14 day
<br /> of July , 1986, regarding such request; and,
<br /> ~~HEREAS, a11 requirements of Appendix A, General Zoning
<br /> Ordinance, of the Code of Ordinances of the City of San Marcos
<br /> pertaining to amendments have been met; and,
<br /> WHEREAS, said City Council hereby finds and determines that the
<br /> adoption of the following ordinance is in the interest of the publ ic
<br /> health, morals, welfare and safety; now, therefore,
<br /> BE IT ORDAINED BY THE CITY CO~~CIL OF THE CITY OF SAN MARCOS, TEXAS:
<br /> SECn ON 1. That the following described tract of real proper ty
<br /> located in San Marcos, Hays County, Texas, which is presently zoned
<br /> "Mo (Single, Duplex and Neighborhood Businesses District)
<br /> hencefor th shall be rezoned "t1F-3" (Mu t 1 i -Fam i 1 y District):
<br /> LOTS 11, 12, 13 AND 14 OF THE B.G. COLLIER SUBDIVISION NEAR SAN
<br /> MARCOS, HAYS COUNTY, TEXAS, A PORT I ON OF THE J .M. VEh'i'IENDI
<br /> SURVEY, HAYS COUNTY, TEXAS AS RECORDED IN VOLUME 108, PAGE 34 OF
<br /> THE HAYS COUNTY DEED RECORDS.
<br /> SECTION 2. That this Ordinance shall be in effect ten (10) days
<br /> from and after its passage and after it has been subject to
<br /> reconsideration by the Council at its next regular meeting following
<br /> its passage, and providing that the Council did not vote to reconsider
<br /> it. If reconsidered on July 28, 1986 it shall be in effect ten
<br /> days from and after its passage on that date if approved. It shall not
<br /> go into effect if denied. If not reconsidered or if reconsidered and
<br /> approved it shall be publ ished in a newspaper of general circulation in
<br /> the area as required by the Charter of the City of San Marcos, Texas.
<br /> PASSED, APPROVED AND ADOPTED this the 14 day of July, 1986 ,
<br /> subject to reconsideration at the next regular City Council meeting
<br /> scheduled for July 28, 1986 .
