<br />REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS,
<br />STRUCTURES AND LAND, DATED JUNE 13, 1984 (VOL. 66) BY
<br />ZONING PREI..)10USLY UNZONED PROPERTY TO A ZONiNG DESIGNATION
<br />OF "C" (COt1MERCIAL DI STRI CT), BEING 3.7463 ACRES OF LAND
<br />SITUATED IN A TRACT CALLED THE SECOND TRACT IN A
<br />CONVEYANCE FROM A.B. ROGERS AND WILL G. BARBER TO EDWIN C.
<br />WILLIS, VOLUME 107, PAGE 130, DEED RECORDS, T.H.W.
<br />FORSYTH SURVEY, HAYS COUNTY, TEXAS AND LOCATED IN THE
<br />1700 BLOCK OF RANCH ROAD 12 IN SAN MARCOS, TÐ(AS; AND
<br />DECLARING AN EFFECTIVE DATE.

<br />WHEREAS, on July 1, 1986, the Zoning Commission of the City of
<br />San Marcos held a publ ic hearing regarding a request to zone
<br />previously unzoned property to a zoning designation of "C"
<br />(Commercial District), being 3.7463 acres of land situated in the
<br />T.H.W. Forsyth Suruey, in the City of San Marcos, Hays County, Texas;
<br />and,
<br />
<br />WHEREAS, subsequent to said publ ic hearing on said date, said
<br />Commission did, on July 1, 1986, consider said request and
<br />voted to approve the same and has recommended that such request be
<br />approved by the City Council of said City; and,
<br />
<br />WHEREAS, said City Council held a pub} ic hearing on the 25 day
<br />of August, 1986, regarding such request; and,
<br />
<br />WHEREAS, all requirements of Appendix A, Genera} Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the pubi ic
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS:
<br />
<br />SECTION 1. That the following described tract of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />Unzoned henceforth shall be zoned "C" (Commercial District):

<br />Field Notes describing 3.7463 acres of ¡and situated in a tract
<br />cailed the Second Tract in a conveyance from A.B. Rogers and
<br />¡,<Jill G. Barber to Edwin C. IAill is, Volume 107, Page 130, Deed
<br />Records, T.H.W. Forsyth Survey, Hays County, Texas, and
<br />described by metes and bounds as follows:

<br />BEGINNING at an iron pin found marKing the west corner of this
<br />tract, the west corner of the called Second Tract, the south
<br />corner of a tract called 9.75 acres in a conveyance recorded in
<br />Volume 138, Page 364, and situated in the northeast 1 ine of a
<br />tract called the First Tract described in Volume 107, Page 130,
<br />Deed Records, Hays County, Texas;
<br />
<br />THENCE with the fenced common 1 ine between the ca11ed Second
<br />Tract and the called 9.75 acre tract, N 47°32/59"E 341.84 feet,
<br />N 46°30/ 27"E 158.1 feet, N 46°16/ 19"E 158.29 feet and N 4~26'
<br />42"E 3.2 feet to a point marKing the north corner of this tract;
<br />
<br />THENCE S 79°44/ E 272.96 feet to a point marKing the east corner
<br />of this tract situated in the common 1 ine between the Forsyth
<br />Survey and the E. Clark Survey;
<br />
<br />THENCE with the fenced common 1 ine between the Forsyth Survey
<br />and the E. Clark SurtJey, S 46°30" 27" tAl 133.61 feet to an iron
<br />pin found, S 46° 33/2~" W 399.12 feet and S 46°17/42"W 282.47
<br />feet to an iron pin marKing the south corner of this tract, the
<br />east corner of the called First Tract;
<br />
<br />THENCE with the common 1 ine between the called Second Tract and
<br />the called First Tract, N 4~ 24/ W 226.55 feet to the PLACE OF
<br />BEGINNING and containing 3.7463 acres of land.
