<br /> 15 <br /> RESOLUTION 1985-39R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE <br /> CITY OF SAN MARCOS, TEXAS, RATIFYING THE <br /> EXECUTION BY THE CITY MANAGER OF A <br /> COMPROMISE SETTLEMENT AGREEMENT AND <br /> RELEASE IN CONNECTION WITH A DISPUTE <br /> BETWEEN SAID CITY AND FREESE AND NICHOLS, <br /> INC. OVER THE DESIGN AND CONSTRUCTION OF <br /> FIRE STATION NO. 4 IN SAID CITY AND <br /> APP ROVING THE TERMS AND CONDITIONS <br /> RECITED THEREIN; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, a dispute has arisen between the City of San <br /> Marcos, Texas, and Freese and Nichols, Inc. over the design <br /> and construction of the apparatus room floor, sidewalks and <br /> driveways of Fire Station No. 4 in said City; and, <br /> WHEREAS, the City Manager, on behalf of said City, has <br /> executed a Compromise Settlement Agreement and Release in <br /> connection with said dispute; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> PART 1. That the execution by the City Manager of a <br /> Compromise Settlement Agreement and Release in connection <br /> with a dispute between said City and Freese and Nichol s , <br /> Inc. over the design and construction of the apparatus room <br /> floor, sidewalks and driveways of Fire Station No. 4 in <br /> said City, copies of which Agreement and Release are <br /> attached hereto and incorporated herein for all purposes, <br /> is hereby ratified in all respects, and the terms and <br /> conditions contained in said Agreement and Release are <br /> hereby in all things approved. <br /> PART 2.
