30 RESOLUTION 1~85-44R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A PROPOSED PIPE LINE LICENSE AGREEMENT BETWEEN SAID CITY AND THE MISSOURI-KANSAS-TEXAS RAILROAD COMPANY FOR THE INSTALLATION AND MAINTENANCE OF TWO (2) SIXTY INCH (60") CORRUGATED METAL STORM DRAINAGE PIPES IN SAID CITY AND UPON RAILROAD COMPANY RIGHT-OF-WAY AT MILE POST M-5l.7; AUTHORIZING THE EXECUTION OF SAID AGREEMENT AND ANY AND ALL OTHER DOCUMENTS AND INSTRUMENTS INCIDENT THERETO BY THE MAYOR; AND DECLARING AN EFFECTIVE DATE. WHEREAS, it is necessary that two (2) sixty inch (60") corrugated metal storm drainage pipes to be installed in the City of San Marcos be located on property belonging to the Missouri-Kansas-Texas Railroad Company at Mile Post M-5l.7; and, WHEREAS, it is necessary that a Pipe Line License Agreement be entered into between said City and said Railroad Company prior to the installation of said drainage pipes; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the terms and conditions of the Pipe Line License Agreement between said City and the Missouri-Kansas-Texas Railroad Company, a copy of which License is attached hereto and incorporated herein for all purposes, are hereby in all things approved. PART 2. That the Mayor, Emmie Craddock, be, and she is hereby, authorized to execute said Pipe Line License on behalf of said City and any and all other documents and instruments incident thereto.
