RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, AUTHORIZING SAID CITY'S ONE-YEAR <br /> PARTICIPATION IN PURCHASING PROGRAMS OF THE STATE <br /> PURCHASING AND GENERAL SERVICES COMMISSION FOR THE <br /> ACQUISITION OF FOUR (4) POLICE PURSUIT VEHICLES; <br /> REQUESTING THE STATE PURCHASING AND GENERAL <br /> SERVICES COMMISSION TO INCLUDE SAID CITY'S STATED <br /> NEED FOR SUCH VEHICLES ON THE COMMISSION'S ANNUAL <br /> CONTRACTS FOR THOSE ITEMS; AUTHORIZING AND <br /> DIRECTING THE CI'rY MANAGER TO SIGN AND DELIVER ALL <br /> NECESSARY REQUESTS AND OTHER DOCUMENTS IN <br /> CONNECTION THEREWITH; DIRECTING THAT ALL DECISIONS <br /> OF THE CITY MANAGER RELATING TO SAID PURCHASING <br /> PROGRAMS SHALL BE AS DIRECTED BY THE CITY COUNCIL; <br /> PROVIDING THAT SAID CITY WILL PURCHASE SUCH <br /> VEHICLES FROM THE CONTRACTS MADE PURSUANT TO THIS <br /> RESOLUTION AND ARTICLE 664-7, V.T.C.S., EXCEprr IN <br /> EMERGENCIES AND THAT SAID CITY WILL BE RESPONSIBLE <br /> FOR PAYMENT DIRECTLY TO THE VENDOR UNDER EACH SUCH <br /> CONTRACT AND WILL BE RESPONSIBLE FOR THE VENDOR'S <br /> COMPLIANCE WITH ALL CONDITIONS OF DELIVERY AND <br /> QUALITY OF PURCHASED ITEMS; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the City of San Marcos, Texas, pursuant to the <br /> authority granted by Article 664-7, Vernon's Texas civil Statutes, <br /> as amended, desires to participate in certain below described <br /> purchasing programs of the State Purchasing and General Services <br /> Commission; and <br /> WHEREAS, the City Council of said City is of the opinion that <br /> participation in these programs will be highly beneficial to the <br /> taxpayers of this City through the anticipated savings to be <br /> realized; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. That the City of San Marcos, Texas, does hereby <br /> request the State Purchasing and General Services Commission to <br /> include said City's stated need for four (4) Police Pursuit <br /> Vehicles on the Commission's annual contracts for those items, <br /> whereby the City may be allowed to purchase those items from the <br /> annual contract in question. <br /> PART 2. That said City's participation in such purchasing <br /> programs of the State Purchasing and General Services Commission <br /> for the acquisition of such Police Pursuit Vehicles is hereby <br /> authorized. <br /> PART 3. That the City Manager, A.C. Gonzalez, be, and is <br /> hereby, authorized and directed to sign and deliver all necessary <br /> requests and other documents in connection therewith for and on <br /> behalf of said City. <br /> PART 4. That all decisions of said City Manager relating to <br /> said purchasing program will be directed by the City Council. <br /> PART 5. That the City of San Marcos, Texas, will purchase <br /> said Police Pursuit Vehicles from the contracts made pursuant to <br /> this Resolution and Article 664-7, V.T.C.S., except in <br /> emergencies, and will be responsible for payment directly to the <br /> vendor under each such contract and will be responsible for the <br /> vendor's compliance with all conditions of delivery and quality of <br /> purchased items. <br />
