<br /> 10 <br /> RESOLUTION 1985-113R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SAN MARCOS, TEXAS, AUTHORIZING SAID CITY'S <br /> ONE-YEAR PARTICIPATION IN PURCHASING PROGRAMS <br /> OF THE STATE PURCHASING AND GENERAL SERVICES <br /> COMMISSION FOR THE ACQUISITION OF AUTOMOBILES <br /> AND LIGHT DUTY TRUCKS AND TIRES AND TUBES; <br /> REQUESTING THE STATE PURCHASING AND GENERAL <br /> SERVICES COIvlMISSION TO INCLUDE SAID CITY'S <br /> STATED NEED FOR CONTRACT CLASSES NOS. 070 AND <br /> 863, AUTOMOBILES AND LIGHT DUTY TRUCKS AND <br /> TIRES AND TUBES RESPECTIVELY, ON 'rHE <br /> COMMISSION'S ANNUAL CONTRACTS FOR THOSE ITEMS; <br /> AUTHORIZING AND DIRECTING THE CITY MANAGER TO <br /> SIGN AND DELIVER ALL NECESSARY REQUESTS AND <br /> OTHER DOCUMENTS IN CONNECTION THEREWITH; <br /> DIRECTING THAT ALL DECISIONS OF THE CITY <br /> MANAGER RELATING TO SAID PURCHASING PROGRAMS <br /> SHALL BE AS DIREcrrED BY THE CITY COUNCIL; <br /> PROVIDING THAT SAID CITY WILL PURCHASE SUCH <br /> ITEMS FROM THE CONTRACTS MADE PURSUANT TO THIS <br /> RESOLUTION AND ARTICLE 664-7, V.T.C.S., EXCEPT <br /> IN EMERGENCIES, AND THAT SAID CITY WILL BE <br /> RESPONSIBLE FOR PAYIvlENT DIRECTLY TO THE VENDOR <br /> UNDER EACH SUCH CONTRACT AND WILL BE <br /> RESPONSIBLE FOR THE VENDOR'S COMPLIANCE WITH <br /> ALL CONDITIONS OF DELIVERY AND QUALITY OF <br /> PURCHASED ITEMS; AND DECLAEING AN EFFECTIVE <br /> DATE. <br /> WHEREAS, the City of San Ivlarcos, Texas, pursuant to the <br /> authority granted by Article 664-7, Vernon's Texas Civil Statutes <br /> (V.T.C.S.), as amended, desires to participate in certain below <br /> described purchasing programs of the State Purchasing and General <br /> Services Commission; and, <br /> WHEREAS, the City Council of said City is of the opinion that <br /> participation in these programs will be highly beneficial to the <br /> taxpayers of this City through the anticipated savings to be <br /> realized; now, therefore, <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN IvlARCOS, <br /> TEXAS: <br /> PART 1. That the City of San Marcos, Texas, does hereby <br /> request the State Purchasing and General Services Commission to <br /> include said City's stated need for Contract Classes Nos. 070 and <br /> 863, Automobiles and Light Duty Trucks and Tires and Tubes, <br /> respectively, on the Commission's annual contracts for those <br /> items, whereby the City may be allowed to purchase those items <br /> from the annual contract in question. <br /> PART 2. That said City's participation in such purchasing <br /> programs of the State Purchasing and General Services Commission <br /> for the acquisition of such items is hereby authorized. <br /> PART 3. That the City Manager, A.C. Gonzalez, is hereby <br /> authorized and directed to sign and deliver all necessary requests <br /> and other documents in connection therewith for and on behalf of <br /> said City. <br /> PART 4. That all decisions of said City Manager relating to <br /> said purchasing programs will be directed by the City Council. <br /> PART 5. That the City of San Marcos, Texas, will purchase <br /> said items from the contracts made pursuant to this Resolution and <br /> Article 664-7, V.T.C.S., except in emergencies, and will be <br /> responsible for payment directly to the vendor under each such <br /> contract and will be responsible for the vendor's compliance with <br /> all conditions of delivery and quality of purchased items. <br />
