41 ORDINANCE 1984-76 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 5, ARTICLE II, DIVISION 1, SEc'rION 5-16 OF THE CODE OF ORDINANCES OF SAID CITY TO ADOPT THE 1982 EDITION OF THE STANDARD BUILDING CODE AND THE 1983 REVISIONS THERETO; AMENDING DIVISION 1 OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO ADD A SECTION TO BE NUMBERED 5-18 TO PROVIDE FOR EXEMPTION FROM THE PAYMENT OF LICENSE J:o'EES OR BONDS BY BUILDERS FOR BUILDER-OWNED AND OCCUPIED RESIDENCES; AMENDING SECTION 5-26 OF DIVISION 2 OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO CHANGE THE NUMBER OF SAID SECTION TO CONFORM TO THE 1982 EDITION OF SAID BUILDING CODE AND TO PROVIDE FOR EXEMPTION FROM THE P AYMENrr OF LICENSE FEES OR BONDS OF BUILDERS FOR BUILDER-OWNED AND OCCUPIED RESIDENCES, IN ACCORDANCE WITH SECTION 5-18 OF DIVISION 1 OF SAID ARTICLE OF SAID CHAPTER 5-18 OF DIVISION 1 OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE; REPEALING SECTION 5-27 OF DIVISION 2 OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE; AMENDING DIVISION 2 OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO ADD A SECTION TO BE NUMBERED 5-27 TO AMEND SECTION 108.2(c) OF SAID BUILDING CODE TO REQUIRE THE PROVISION TO THE BUILDING OFFICIAL OF JOB SITE ACCESS FOR THE PERFORMANCE OF INSPECTIONS; AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Chapter 5, Article II, Division 1, Section 5-16 of the Code of Ordinances, City of San Marcos, Texas is hereby amended to read as follows: Sec. 5-16. There is hereby adopted by the City of San Marcos, Texas, for the purpose of establishing rules and regulations governing the construction, alteration, removal, demolition, equipment, use and occupancy, location, and maintenance of buildings and structures including permits and penalties, that certain building code known as the Standard Building Code, being particularly the 1982 edition; published by the Southern Building Code Congress International, Inc., 900 Montclair Road, Birmingham, Alabama 35213-1206, and the 1983 revisions thereto, and as hereafter amended, save and except such portions as are hereafter modified or amended, a copy of which said Code and revisions thereto have been and are now filed in the office of the city secretary of the City of San Marcos, and the same are hereby adopted and incorporated as fully as if set out full length herein, and from and after August 3, 1984, the effective date of this section, the provisions thereof shall be controlling in the construction of all buildings and other structures contained within the corporate limits of the City of San Marcos, Texas and its extraterritorial jurisdiction, subject to the laws of the State of Texas.
