53 ORDINANCE 1984-77 AN ORDINANCE OF 'rHE Crry COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING APPENDIX F, INTERIM DRAINAGE AND EROSION CONTROL ORDINANCE, OF THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS, TO DELETE SECTION 5, TO RENUMBER SECTIONS 6 THROUGH 18, TO DELETE THE REFERENCE TO SECTION 5 FOUND IN SECTION 4(F), AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That Appendix F, Interim Drainage and Erosion Control Ordinance, of the Code of Ordinances of the City of San Marcos, Texas be amended to delete Section 5 in its entirety. SECTION 2. That Appendix F, Interim Drainage and Erosion Con"tro1 Ordinance of the City of San Marco s, Texas be amended by renumbering the following sections as indicated below: Section 6. Certification by a registered professional engineer, is renumbered to Section 5. Section 7. Burden of proof, is renumbered to Section 6. Section 8. Inspection and enforcement, is renumbered to Section 7. Section 9. Drainage improvements maintenance criteria, is renumbered to Section 8. Section 10. Variances, is renumbered to Section 9. Section 11. Automatic issuance of permit if not denied; reasons for denial required, is renumbered to Section 10. Section 12. Aggrieved property owner may appe al denial of permit to the City Council, is renumbered to Section 11. Section 13. Appeal of issuance of permit, is renumbered to Section 12. Section 14. Permit fees, is renumbered to Section 13. Section 15. Penalty, is renumbered to Section 14. Section 16. Definitions, is renumbered to Section 15. Section 17. Conflict with other ordinances, is renumbered to Section 16. Section 18. Separability, is renumbered to Section 17. SECTION 3. That Section 4(f) of Appendix F, Interim Drainage and Erosion Control Ordinance, of the Code of Ordinances of the City of San Marcos, Texas be amended to delete the last six (6) words of the second sentence of said Section 4 ( f), said words being "except in accordance with Section 5. " SECTION 4. That this Ordinance shall be in effect ten (10) days from and after its passage and after its publication in a newspaper of general circulation in the area.
