<br /> 33 <br /> 9- <br /> ORDINANCE 1983-60 <br /> ÀN ORDINANCE OF THE CITY COUNCIL OF THE CITY ~ <br /> Qr SAN MARCOS, TEXAS, ESTABLISHING A TEMPORARY 0() <br /> MbRATORIUM ON THE RECEIPT OF APPLICATIONS FOR <br /> ii:wILDING PERMITS WHICH INCLUDE PLUMBING FOR <br /> """,I <br /> CONSTRUCTION WITHIN THE CORPORATE LIMITS OF <br /> ,~E CITY OF SAN MARCOS, TEXAS, AND DECLARING <br /> ðN EMERGENCY. <br /> WHEREAS, the City Council of the City of San Marcos, <br /> Texas, has determined that the existing sewer plant of the <br /> City of San Marcos handling the current waste generated by <br /> the citizens of San Marcos must be upgraded; and, <br /> WHEREAS, the City Council of the City of San Marcos, <br /> Texas, has determined that in order to provide for the future <br /> growth of San Marcos additional sewer plant facilities will <br /> have to be constructed; and, <br /> WHEREAS, the City Council has considered the total cost <br /> of making such improvements and the information presented <br /> regarding which segments of the community are responsible for <br /> which amount of the additional cost to be incurred; and, <br /> WHEREAS, the City Council has determined that new <br /> development should bear its share of the cost of improvements <br /> and that existing development should bear its share of the <br /> cost of improvements; and, <br /> wHEREAS, the City of San Marcos intends to consider an <br /> ordinance to establish a Capital Recovery Fee on all new <br /> building permits which include plumbing; and, <br /> WHEREAS, the City of San Marcos staff has received <br /> numerous inquiries and expressions of interest for <br /> development and construction within the corporate limits of <br /> the City of San Marcos; and, <br /> wHEREAS, the City Council desires to establish a time to <br /> hold In abeyance the acceptance by the City of San Marcos <br /> staff of building permit applications which include plumbing <br /> to provide the City Council with an opportunity to consider <br /> the merits and details of a Capital Recovery Fee and the <br /> status of the sewerage system in respect to proposals for new <br /> development, construction, and population and structural <br /> growth within the corporate limits of the City of San Marcos; <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS: <br /> SECTION 1. That a moratorium on all new building <br /> permits applications which include plumbing to the City of <br /> San Marcos staff be in effect immediately. <br /> SECTION 2. That no building permits which include <br /> plumbing will be issued, except for applications submitted to <br /> the City of San Marcos staff prior to the effectuation of <br /> this ordinance, or building applications which include <br /> plumbing received until December 28, 1983, except in the <br /> event that the City Council should adopt a Capital Recovery <br /> Fee ordinance, which, in such event, this Ordinance shall be <br /> superseded by such Capital Recovery Fee ordinance and this <br /> Ordinance shall thereby immediately and automatically be <br /> rescinded, or except in the event that the city Council <br /> should adopt an ordinance continuing the moratorium <br /> established herein for a longer period of time. <br />
