RESOLUTION 2014 -111R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING ADVANCE FUNDING AGREEMENT AMENDMENT NO. 2 TO LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT (CSJ- 0914 -33 -032) BETWEEN THE CITY AND THE STATE OF TEXAS ACTING THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION ( "TXDOT ") FOR THE SESSOM STREET CONSTRUCTION PROJECT TO TRANSFER $370,000.00 TO THE NORTH LBJ CONSTRUCTION PROJECT; APPROVING ADVANCE FUNDING AGREEMENT AMENDMENT NO. 2 TO THE LOCAL TRANSPORTATION PROJECT ADVANCE FUNDING AGREEMENT (CSJ - 0914-33 -033) TO INCREASE THE FUNDING FOR THE NORTH LBJ DRIVE IMPROVEMENT PROJECT BY $370,000.00; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE BOTH AMENDMENTS ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. 1. On February T,2006 the City Council approved a Local Transportation Project Advance Funding Agreement ( "AFA ") with the State of Texas acting through the Texas Department of Transportation ( "TxDOT "), Project Number: CSJ 0914 -33 -032, for the Sessom Drive Construction Project. 2. On February 7, 2006 the City Council approved a Local Transportation Project Advance Funding Agreement ( "AFA ") with the State of Texas acting through the Texas Department of Transportation ( "TxDOT "), Project Number: CSJ 0914 -33 -033, for the North LBJ Drive Improvement Project. 3. The City has requested that $370,000.00 from funding allocated to the Sessom Street Construction Project be transferred to the North LBJ Drive Improvement Project to reflect the cost of the intersection improvements at Sessom and North LBJ Drive and TxDOT has concurred. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Amendment No. 2 transferring $370,000.00 from Local Transportation Project Advance Funding Agreement (CSJ- 0914 -33 -032) for the Sessom Street Construction Project to the North LBJ Drive Improvement Project is approved. PART 2. The attached Amendment No. 2 increasing Local Transportation Project Advance Funding Agreement (CSJ- 0914 -33 -033) by $370,000.00 for the North LBJ Improvement Project is approved.
