94 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, NOVEMBER 6, 1989 PRESENT: Mayor Kathy M. Morris Mayor Pro-Tem Rick Hernandez Council Members Billy G. Moore Ronald K. Hart Fred Guerra Betty Jane Kissler * Bill Plummer City Manager * Larry Gilley Acting City Manager and Director of Library Stephanie Langenkamp City Secretary Janis K. Womack City Attorney Mark Taylor Director of Public Works George Boeker Also Present: Nick Caruso, Patty Wenk, Melissa Millecam, R. G. Phillips, Richard Dotson, Bill Coddington, Jenny Kile, Mrs. Mark Taylor, Collette Boruff and others. Mayor Morris called the meeting to order at 12:00 Noon. Mayor Morris introduced for consideration adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A CONTRACT FOR PROFESSIONAL SERVICES BETWEEN THE CITY AND TEXAS INDUSTRIAL WASTE CONTROL, INC., FOR THE PROVISION OF ENVIRONMENTAL CONSULTING SERVICES IN SUPPORT OF THE CITY OF SAN MARCOS INDUSTRIAL WASTE ORDINANCE; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT AND DECLARING AN EFFECTIVE DATE. Mr. Hernandez moved for adoption of the Resolution and Ms. Kissler seconded the motion. Mr. Boeker advised the Council the City is required to have a pre-treatment program but does not have enough Staff to enforce the Industrial Waste Ordinance. During the budget process, Staff determined it would be cheaper to employ a consultant rather than budget Staff, and that if the City is involved in enforcement actions, we will need to have the expertise to move forward. If additional testing is required, the contract amount could exceed the $21,300. The Council voted unanimously for adoption of the Resolution. Mayor Morris introduced for consideration an Executive Session pursuant to Article 6252-17, Section 2(e), V.A.C.S., to. discuss contemplated litigation involving the request for information by the Taxpayer's Audit Group. Mr. Hernandez moved the Council adjourn into Executive Session at 12:20 p.m. and Mr. Moore seconded the motion, which passed unanimously. Mr. Hernandez moved the Council reconvene at 12:50 p.m. and Mr. Moore seconded the motion, which passed unanimously. Mayor Morris introduced for consideration authorization to initiate litigation pertaining to the request for information by the Taxpayer's Audit Group. No action was taken on this item, as the Council chose not to appeal.
