Womack <br /> City Attorney Mark Taylor <br /> Director of Public Works George Boeker <br /> Also Present: Nick Caruso, Patty Wenk, Melissa Millecam, R. G. <br /> Phillips, Richard Dotson, Bill Coddington, Jenny Kile, Mrs. Mark <br /> Taylor, Collette Boruff and others. <br /> Mayor Morris called the meeting to order at 12:00 Noon. <br /> Mayor Morris introduced for consideration adoption of a <br /> Resolution, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS, APPROVING THE TERMS AND CONDITIONS OF A CONTRACT FOR <br /> PROFESSIONAL SERVICES BETWEEN THE CITY AND TEXAS INDUSTRIAL <br /> WASTE CONTROL, INC., FOR THE PROVISION OF ENVIRONMENTAL <br /> CONSULTING SERVICES IN SUPPORT OF THE CITY OF SAN MARCOS <br /> INDUSTRIAL WASTE ORDINANCE; AUTHORIZING THE CITY MANAGER TO <br /> EXECUTE SAID CONTRACT AND DECLARING AN EFFECTIVE DATE. <br /> Mr. Hernandez moved for adoption of the Resolution and Ms. <br /> Kissler seconded the motion. Mr. Boeker advised the Council the <br /> City is required to have a pre-treatment program but does not <br /> have enough Staff to enforce the Industrial Waste Ordinance. <br /> During the budget process, Staff determined it would be cheaper <br /> to employ a consultant rather than budget Staff, and that if the <br /> City is involved in enforcement actions, we will need to have the <br /> expertise to move forward. If additional testing is required, <br /> the contract amount could exceed the $21,300. The Council voted <br /> unanimously for adoption of the Resolution. <br /> Mayor Morris introduced for consideration an Executive Session <br /> pursuant to Article 6252-17, Section 2(e), V.A.C.S., to. discuss <br /> contemplated litigation involving the request for information by <br /> the Taxpayer's Audit Group. Mr. Hernandez moved the Council <br /> adjourn into Executive Session at 12:20 p.m. and Mr. Moore <br /> seconded the motion, which passed unanimously. <br /> Mr. Hernandez moved the Council reconvene at 12:50 p.m. and Mr. <br /> Moore seconded the motion, which passed unanimously. <br /> Mayor Morris introduced for consideration authorization to <br /> initiate litigation pertaining to the request for information by <br /> the Taxpayer's Audit Group. No action was taken on this item, as <br /> the Council chose not to appeal. <br /> The meeting adjourned at 1:02 p.m. on motion made by Mr. <br /> Hernandez and seconded by Ms. Kissler. <br /> .~ <br /> ~iS <br /> * Mr. Plummer and Mr. Gilley were not present at this meeting. <br />
