<br />I <br /> <br />RESOLUTION NO. 2007- 197 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS. APPROVING AN OVERSIZE WATERLINE AND <br />WASTEWATER LINE REIMBURSEMENT AGREEMENT WITH <br />HUNTER ROAD I & II, LP; AUTHORIZING THE INTERIM CITY <br />MANAGER TO EXECUTE THE AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. During the construction of the new Town Center Subdivision, Phase I, Hunter <br />Road I & II, LP ("Hunter Road") needed to construct new water line and waste water <br />line utilities. <br /> <br />2. In order to serve future development of the area City staff determined that <br />over sizing both the water and waste water lines would be in the City's best interest. <br />Hunter Road had its engineer Byrn & Associates, prepare a cost proposal for the <br />needed work and for the work with the City's additional requirements. In accordance <br />with the cost proposal the City's share of the project is $71,796.00. <br /> <br />I <br /> <br />3. In order to reimburse Hunter Road for the oversize work to be performed at <br />the request of the City, the attached Agreement must be executed. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached agreement, between the City of San Marcos, Texas and <br />Hunter Road I & II, LP is approved. <br /> <br />PART 2. The Interim City Manager, Collette Jamison, is authorized to execute <br />the agreement on behalf of the City. <br /> <br />PART 3.
