ORDINANCE NO. 2014 -75 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE INSTALLATION OF SPEED <br />CUSHIONS IN BOTH DIRECTIONS IN THE 1600 THROUGH 1900 <br />BLOCKS OF MILL STREET (FROM UHLAND ROAD TO TELLURIDE <br />STREET); AND INCLUDING PROCEDURAL PROVISIONS. <br />RECITALS: <br />1. Mill Street is a two -way collector street. A traffic study indicates that the 85th <br />percentile speed in the 1600 to 1900 blocks of Mill Street is 34.8 miles per hour, and the 85th <br />percentile southbound speed is 41.8 mile per hour, both of which are in excess of the posted <br />speed limit. <br />2. Such traffic conditions are not safe for residents and residents have petitioned <br />the City to install speed cushions on said blocks of Mill Street. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SATI MARCOS, <br />SECTION 1. The Recitals are hereby found to be true and correct and are adopted as the <br />findings of the City Council. <br />SECTION 2. Pursuant to Section 82.066 of the San Marcos Code, on the basis of such <br />findings, the City Council hereby authorizes the installation of speed cushions in the 1400 to 1900 <br />blocks of Mill Street (from Uhland Road to Telluride Street). <br />SECTION 3. The installation of signs providing notice of the presence of the speed <br />cushions is also hereby authorized. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br />SECTION 6. This ordinance shall be effective upon its adoption on second reading. <br />PASSED AND APPROVED on first reading on December 16, 2014. <br />PASSED, APPROVED AND ADOPTED on second reading on January 6, 2015. <br />
