0 RESOLUTION 2009- 55 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE GRANT OF AN <br />EASEMENT BEHIND BOBCAT STADIUM TOTALING 0.06 ACRES, <br />MORE OR LESS TO TEXAS STATE UNIVERSITY FOR PARKING <br />LOT ACCESS; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE EASEMENT DOCUMENTS; AND DECLARING AN <br />EFFECTIVE DATE. <br />RECITALS: <br />1. A request was made by Texas State University for an easement over a small parcel <br />of land that lies next to an easement granted by the City to Hidden Village (recently <br />purchased by Texas State University). <br />2. The University is constructing a parking lot on the Hidden Village property and <br />needs the easement to construct a road to connect the Hidden Village property with the <br />parking lot that bounds the north side of Bobcat Stadium. The University will be <br />responsible for any changes to utilities that must be made to accommodate the <br />roadway. <br />• 3. Granting this easement will be in the best interest of the public as the building of the <br />roadway will help relieve traffic patterns around the stadium, and will help in the <br />provision of more parking spaces for Texas State students and the public attending <br />sporting events in the area. This will help in relieving congestion on the surrounding <br />streets. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The following grant of an easement to Texas State University for the <br />construction of a roadway is hereby approved: <br />A. the easement being 0.06 acres, more or less, triangular piece of land as <br />more particularly described in the "Exhibit A" attached to the Easement that is attached <br />to this Resolution. <br />Part 2. The City Manager, Rick Menchaca, is authorized to execute the <br />easement attached to this resolution on behalf of the City. <br />0
