FILE D O'Clo ORDINANCE NO. 1981-72 A G 2 1 19X31 "--=FETARY AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF S t' ) MARCOS, TEXAS, ABANDONING, VACATING AND CLOSING A?'tY of Sara Marcos PORTION OF AN ALLEY IN BLOCK 3 OF THE WESTOVER ADDI- TION TO THE CITY OF SAN MARCOS, TEXAS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND AND DECLARING AN EFFECTIVE DATE. WHEREAS, a portion of the alley in Block 3 of the Westover Additon to the City of San Marcos, said portion located within the corporate limits of the City of San Marcos, Texas, was and is dedicated to public use as shown on the plat of said subdivision in Volume 59, Page 184 of the Deed Records, Hays County, Texas; and, WHEREAS, the City of San Marcos has received from Robert C. Haney a petition requesting the abandonment by said City of said portion; and, WHEREAS, the City of San Marcos has duly determined that Robert C. Haney is the sole owner of all property abutting said portion of said alley; and, WHEREAS, the City Council of the City of San Marcos, Texas, has deter- mined that it is in the public interest to abandon said portion of said alley; and, WHEREAS, the owner of all land abutting said alley has executed a release, discharging said City from any damages occasioned by said abandon- ment; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. That a portion of the alley in Block 3 of the Westover Addition to the City of San Marcos, Texas, said portion lying between Lots 20, 21 and 22 and Lots 23, 24 and 25 and shown on the attached Exhibit A, be, and is hereby declared to be, and is henceforth, abandoned, vacated and closed as to any use, right or claim in, or responsibility for the upkeep or main- tenance by the public in general and the City of San Marcos in particular. SECTION 2. That the fee to said portion of said alley is hereby released and shall revert to Robert C. Haney save and except that easements are reserved for any and all existing utilities. SECTION 3. That this Ordinance shall be effective ten (10) days from and after its passage and publication in a newspaper of general circulation. PASSED AND APPROVED on first reading August 24, 1981.
