RESOLUTION 2016 -66R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AGREEMENT WITH LJA <br />ENGINEERING, INC. FOR THE PROVISION OF PROFESSIONAL <br />ENGINEERING SERVICES IN CONNECTION WITH THE NORTH <br />BISHOP STREET SIDEWALK PROJECT IN THE AMOUNT OF <br />$148,078.50 WHICH INCLUDES AN INCREASE OF $98,085.50 (ACIS NO. <br />1) ABOVE THE PREVIOUS NOT -TO- EXCEED CONTRACT AMOUNT <br />OF $49,990.00; RATIFYING THE CITY MANAGER'S EXECUTION OF <br />THIS AGREEMENT ON BEHALF OF THE CITY; AUTHORIZING THE <br />CITY MANAGER OR HIS DESIGNEE TO EXECUTE AUTHORIZATION <br />OF CHANGE IN SERVICES NO. 1 ON BEHALF OF THE CITY AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS <br />1. On December 10, 2015 the City entered into an agreement (the "Agreement ") with <br />LJA Engineering, Inc., for the provision of professional engineering services in connection with <br />the North Bishop Street Sidewalk Project in a not -to- exceed amount of $49,990.00. <br />2. Due to increases in project scope, it is necessary to increase the Agreement by <br />$98,085.50. <br />3. The approval of ACIS No. 1 for $98,085.50 will cause the amount of the Agreement <br />to increase from $49,990.00 to $148,078.50, which exceeds the threshold for administrative <br />approval and triggers the need for City Council's approval of the Agreement. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The Agreement between the City and LJA Engineering, Inc. for the provision <br />of professional engineering services in connection with the North Bishop Street Sidewalk Project <br />in the not to exceed amount of $148,078.50, which includes an increase in price of $98,085.50, is <br />approved. <br />PART 2. The City Manager's execution of the Agreement on behalf of the City is <br />ratified and the City Manager or his designee is authorized to execute ACIS No. 1 on behalf of <br />the City. <br />PART 3. This Resolution shall be in full force and effect immediately from and after its <br />passage. <br />ADOPTED this the 17th day of May, 2016. <br />1 <br />
