ORDINANCE NO. 2016-20 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RCOS, TEXAS AMENDING THE LAND USE MATRIX AND DIMENSIONAL STANDARDS IN CHAPTER FOUR. OF THE CITY'S LAND DEVELOPMENT CODE TO MODIFY THE PERMITTED, CONDITIONAL AND PROHIBITED USES AND ESTABLISH A FOUR STORY BUILDING HEIGHT RESTRICTION WITHIN "P" PUBLIC AND INSTITUTIONAL ZONING DISTRICTS; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. RECITALS: 1. City staff proposed and the Planning and Zoning Commission has considered and recommended approval of revisions and amendments to the City's Land Development Code. 2. The City Council hereby finds and determines that the adoption of the following ordinance incorporating such revisions and amendments is in the interest of the public health, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Subpart B, the Land Development Code, of the City's Code of Ordinances is amended as set forth below. Added text is indicated by underlining. Deleted text is indicated by strikethroughs. SECTION 2. Table 4.1.6.1, Dimensional and Development Standards, is amended as shown in Exhibit "A "' attached hereto and made a part hereof for all purposes. SECTION 3. Table 4.3.1.2, Land Use Matrix, is amended as shown in Exhibit `B "' attached hereto and made a part hereof for all purposes. SECTION 4. In codifying the changes authorized by this ordinance, paragraphs, sections and subsections may be renumbered and reformatted as appropriate consistent with the numbering and formatting of the San Marcos City Code. SECTION 5. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 6. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 7. This ordinance will take effect after its passage, approval and adoption on second reading.
