ORDINANCE AUTHORIZING THE REDEMPTION OF ALL <br /> OUTSTANDING CITY OF SAN MARCOS, TEXAS WATERWORKS AND <br /> WASTE WATER SYSTEM REVENUE BONDS, SERIES 2006 AND <br /> TAXABLE SERIES 2006 <br /> THE STATE OF TEXAS § <br /> COUNTY OF HAYS § <br /> CITY OF SAN MARCOS § <br /> WHEREAS,the CITY OF SAN MARCOS,TEXAS(the"City")and the GUADALUPE-BLANCO <br /> RIVER AUTHORITY("GBRA") originally entered into an Agreement Between City of San Marcos, <br /> Texas and Guadalupe-Blanco River Authority,dated as of July 1, 1997,which was amended several <br /> times and was fully amended and restated by the First Amended and Restated Regional Project <br /> Agreement Between City of San Marcos and Guadalupe-Blanco River Authority,made and entered <br /> into by GBRA and the City as of March 13, 2009 (the "Regional Agreement"), pursuant to which <br /> GBRA and the City agreed to pursue the development of a regional water supply project(the "San <br /> Marcos Regional Water Supply Project"), to meet future water needs and reduce dependence on <br /> the Edwards Aquifer by providing an alternative source of water to the City and surrounding areas <br /> in Hays, Caldwell, Guadalupe and Travis Counties; and <br /> WHEREAS,the Regional Agreement provides that the San Marcos Regional Water Supply <br /> Project will consist of the following primary components: <br /> (i) a raw water delivery system to transport raw water stored in Canyon Reservoir(the <br /> "Raw Water Delivery System," which has been constructed and is owned and <br /> operated by GBRA)to a water treatment plant to be constructed by San Marcos and <br /> operated by an operator selected by San Marcos (the "Plant", which has been <br /> constructed and is owned by the City and currently is operated by GBRA); <br /> (ii) the Plant; and <br /> (iii) a treated water delivery system to transport treated water from the Plant to various <br /> wholesale customers of GBRA located primarily in Hays and Caldwell Counties(the <br /> "Treated Water Delivery System"); and <br /> WHEREAS,the Regional Agreement anticipates that GBRA will contract with other entities <br /> to supply such entities with raw water to, and treated water from, the San Marcos Regional Water <br /> Supply Project; and <br /> WHEREAS, as permitted by the Regional Agreement, GBRA requested the City to expand <br /> the Plant in order to provide additional treated water for the benefit of GBRA and its customers <br /> (which expansion is referred to in the Regional Agreement as the "GBRA Plant Expansion"); and <br />
