Call To Order <br /> With a quorum present,the special meeting of the San Marcos City Council <br /> was called to order by Mayor Pro Tem Thomaides at 10:00 a.m. Friday, <br /> September 2, 2016 in the City Council Chambers, 630 E. Hopkins, San Marcos, <br /> Texas 78666. <br /> II. Roll Call <br /> Mayor Guerrero was absent due to a death in the family. <br /> Council Member Derrick arrived at 10:02 a.m. <br /> Present: 6- Mayor Pro-Tern John Thomaides, Council Member Jude Prather, Deputy Mayor <br /> Pro Tern Lisa Prewitt, Council Member Jane Hughson, Council Member Melissa <br /> Derrick and Council Member Scott Gregson <br /> Absent: 1 - Mayor Daniel Guerrero <br /> EXECUTIVE SESSION <br /> 1. 10:00a.m. Executive Session in accordance with Section § 551.071 of the Texas <br /> Government Code: Consultation with Attorney - to receive advice of legal counsel <br /> regarding issuance of a Certificate of Occupancy for The Woods of San Marcos; and <br /> to receive advice of legal counsel regarding pending litigation, Cause No. 15-0544 -- <br /> Nicholas Flores Lara, et al. v. City of San Marcos, Texas in the District Court 274th <br /> Judicial District Hays County, Texas; and to receive legal advice from the City <br /> Attorney regarding pending litigation, to wit: City of San Marcos, Texas v. Sam <br /> Brannon, Communities For Thriving Water - Fluoride Free San Marcos, Morgan <br /> Knecht and Kathleen O'Connell; Case No. 15-1266 in the 274th District Court of Hays <br /> County Texas; and to receive legal advice regarding the Preferred Scenario <br /> Amendment and zoning process under State Law and the Land Development Code; <br /> and in accordance with Section § 551.074 - Personnel Matters: to discuss the <br /> agreements of the Presiding Judge of the San Marcos Municipal Court of Record and <br /> the Associate Municipal Court Judge; and in accordance with Section § 551.072 of the <br /> Texas Government Code: Real Property - to receive a Staff briefing and deliberate <br /> regarding the possible acquisition of land on Clovis Barker. <br /> A motion was made by Council Member Gregson, seconded by Council <br /> Member Hughson, to enter Closed Session at 10:02 a.m..
