RESOLUTION 2017-121R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS, APPROVING A PROFESSIONAL SERVICES <br /> AGREEMENT WITH KIMLEY-HORN AND ASSOCIATES, INC. FOR <br /> THE PROVISION OF ENGINEERING SERVICES IN CONNECTION <br /> WITH THE SESSOM CREEK WASTEWATER IMPROVEMENTS <br /> PROJECT FROM N. LBJ TO CANYON ROAD IN THE NOT-TO-EXCEED <br /> AMOUNT OF $221,470 CONTINGENT UPON THE ENGINEER'S <br /> PROVISION OF SUFFICIENT INSURANCE IN ACCORDANCE WITH <br /> THE ATTACHED AGREEMENT; AUTHORIZING THE CITY <br /> MANAGER OR HIS DESIGNEE TO EXECUTE THIS AGREEMENT ON <br /> BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The attached professional services agreement between the City and Kimley- <br /> Horn and Associates, Inc. for the provision of engineering services in connection with the Sessom <br /> Creek Wastewater Improvements Project from N. LBJ to Canyon Road Project in the not-to- <br /> exceed amount of$221,470 is approved contingent upon the Engineer's provision of sufficient <br /> insurance in accordance with the attached agreement. <br /> PART 2. The City Manager or his designee is authorized to execute the Agreement on <br /> behalf of the City. <br /> PART 3.
