RESOLUTION NO. 2017-139R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING A FINANCING AGREEMENT WITH <br />WHISPER MASTER COMMUNITY LIMITED PARTNERSHIP AND <br />YARRINGTON PARTNERS LTD. IN CONNECTION WITH THE <br />WHISPER PUBLIC IMPROVEMENT DISTRICT; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE SAID AGREEMENT ON BEHALF OF <br />THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On October 6, 2016, the City Council adopted Resolution No. 2014-143R <br />authorizing the formation of the Whisper Public Improvement District. <br />2. Pursuant to such authorization, the City seeks to approve a financing plan under <br />which the owner of the property within the District will construct the public improvements within <br />the District. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Whisper Public Improvement Financing Agreement is hereby <br />approved. <br />PART 2. The City Manager is authorized to execute the Financing Agreement on <br />behalf of the City. <br />PART 3.
