RESOLUTION NO. 2019-117R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AMENDMENT NO. 3 TO THE <br />AIRPORT PROJECT PARTICIPATION AGREEMENT BETWEEN THE <br />CITY AND THE TEXAS DEPARTMENT OF TRANSPORTATION <br />INITIALLY APPROVED BY RESOLUTION NO. 2015-80R AND THEN <br />AMENDED BY RESOLUTION NO. 2016-80R WHICH AUTHORIZED <br />THE CITY'S ACCEPTANCE OF A GRANT FROM THE TEXAS <br />DEPARTMENT OF TRANSPORTATION FOR THE CONSTRUCTION <br />OF A BOX HANGAR AND ASSOCIATED DEVELOPMENT AT THE SAN <br />MARCOS REGIONAL AIRPORT; TO INCREASE THE ESTIMATED <br />PROJECT COST FROM $816,667 TO $881,200; TO APPROVE THE <br />CITY'S EXPENDITURE OF THE TOTAL PROJECT COST IN LOCAL <br />FUNDS IN THE ESTIMATED AMOUNT OF $214,036.70; AUTHORIZING <br />THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ANY <br />DOCUMENTS NECESSARY FOR THE IMPLEMENTATION OF THE <br />HANGAR DEVELOPMENT PROJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The attached Amendment No. 3 to the Airport Project Participation <br />Agreement between the City and the Texas Department of Transportation Number <br />17HGSMRCO relating to a hangar development project at the San Marcos Regional Airport <br />("Project") is hereby approved. <br />PART 2. The City's expenditure of funds in the estimated amount of $214,036.70 <br />toward the Project is approved. <br />PART 3. The City commits to constructing the Project in a manner consistent with <br />the Airport Layout Plan as approved by the State and to maintaining airport minimum standards, <br />rates and charges that are reasonable and non-discriminatory. <br />PART 4. The City Council names the Texas Department of Transportation as the <br />City's agent for the purposes of applying for, receiving and disbursing all funds for this Project <br />and for the administration of contracts necessary for the implementation of the Project. <br />PART 5. The City Manager is authorized and directed to execute, on behalf of the <br />City, at the appropriate time, and with the appropriate authorization of the City Council, all <br />contracts and agreements with the State of Texas as represented by the Texas Department of <br />Transportation and such other parties as shall be necessary and appropriate for the <br />implementation of the improvements to the San Marcos Regional Airport. <br />
