0 ORDINANCE 2009-54 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 2.021 OF <br />THE SAN MARCOS CITY CODE TO CHANGE THE TIMING <br />OF EVALUATIONS OF THE CITY MANAGER, CITY <br />ATTORNEY, PRESIDING JUDGE, AND CITY CLERK FROM <br />THE FIRST QUARTER TO THE THIRD QUARTER OF EACH <br />CITY FISCAL YEAR; REPEALING SECTION 2.022 WHICH <br />HAS BEEN SUPERCEDED BY CHAPTER 55 PERTAINING <br />TO THE MUNICIPAL COURT OF RECORD; REPEALING <br />SECTION 2.023 AS CONFLICTING WITH SECTION 4.02 OF <br />THE SAN MARCOS CITY CHARTER WHICH PROVIDES <br />FOR THE DIRECT APPOINTMENT OF THE CITY CLERK BY <br />THE CITY COUNCIL; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING AN EFFECTIVE DATE <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Section 2.021 of the San Marcos City Code is amended to read as follows <br />0 (deleted language shown with strikethrough; added language is underlined): <br />Sec. 2.021. Evaluation of council appointees. <br />(a) The city council will perform an annual evaluation of the city manager, city <br />attorney, a+id presiding judge of the municipal court, and city clerk during the <br />€ifst-third quarter of each city fiscal year. <br />(b) The city manager shall perform an annual evaluation of the operations of the <br />municipal court during the first quarter of each city fiscal year, and shall <br />provide a copy of the evaluation to the city council. The city council shall <br />consider the report in its evaluation of the presiding judge of the municipal <br />court. <br /> <br />SECTION 2. Section 2.022 of the San Marcos City Code pertaining to the Municipal <br />Court has been superceded by Chapter 55 pertaining to the municipal court of record. Section <br />2.022 is hereby repealed. <br />SECTION 3. Section 2.023 of the San Marcos City Code which provides that the city <br />clerk performs the duties of that office under the supervision of the city manager is in conflict
