<br />RESOLUTION N0.2008-33R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AN EXTENSION OF THE CITY'S <br />WASTEWATER SYSTEM TO SERVE THE HILLERT TRACT; <br />GRANTING A VARIANCE TO THE REQUIREMENT OF <br />PURCHASING WATER FROM THE CITY OF SAN MARCOS AS A <br />CONDITION OF RECEIVING WASTEWATER TREATMENT <br />SERVICE; AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />San Marcos City Code Section 86.004 requires City Council approval for the extension of City's <br />1 <br />wastewater mains to serve uses outside the City limits. <br />2. San Marcos City Code Section 86.003(c) provides that a variance from the City Council is <br />necessary to receive wastewater service without purchasing water from the City of San Marcos. <br />2. Loomis Austin, on behalf of Rick Anderson and Bob Mayo, (the "Applicant"), has requested <br />permission to extend a City wastewater main to serve the Applicant's property, known as the Hillert Tract <br />which is currently outside the city limits. <br />3. The Hillert Tract is within the water service area of Crystal Clear Water Supply Corporation <br />and granting of a variance from the requirement of purchasing water from the City of San Marcos is <br />appropriate if water service is provided by that entity. <br />4. The City's existing wastewater treatment plant has sufficient capacity to serve the proposed <br />development. <br />5. The Applicant has submitted a written request for annexation of the Property by the City. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The extension of the City's wastewater system mains to serve the Property, to be <br />constructed at the sole expense of the Applicant (subject to the City's policies on oversizing), and on the <br />basis of the Applicant's request for annexation of the Property, is approved. <br />PART 2. A variance to the requirement of purchasing water from the City of San Marcos is hereby <br />granted contingent upon the Crystal Clear Water Supply Corporation providing water service to the Hillert <br />Tract. <br />PART 3.
