ORDINANCE NO. 2020-27 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING ARTICLE 6, DIVISIONS 1 AND 2 OF <br />CHAPTER 2 OF THE SAN MARCOS CITY CODE TO REVISE AND <br />UPDATE THE CITY'S PUBLIC RECORDS MANAGEMENT PROGRAM; <br />INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN <br />EFFECTIVE DATE. <br />1. Title 6, Subtitle C, Texas Local Government Code (Local Government Records <br />Act) provides that each municipality in the State must establish by ordinance an active and <br />continuing records management program to be administered by a Records Management Officer. <br />2. The City of San Marcos desires to amend its current ordinance to ensure the City's <br />Records Management Program is consistent with any updated State laws and take into <br />consideration recent technological advances such as the use of social media. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Chapter 2, Article 6, Division 2, Records Management, of the San Marcos <br />City Code is amended as follows (underlining indicates added text, strikethrough indicates deleted <br />text): <br />SEC. 2.501. DEFINITIONS <br />In this division: <br />City records means all documents, papers, letters, books, maps, <br />photographs, sound or video recordings, microfilm, magnetic tape, electronic <br />media, or other information recording media, regardless of physical form or <br />characteristic, created or received by the City or any of its officers or employees <br />pursuant to law or in the transaction of public business, whether public access to <br />the records is open or restricted under state law. These shall be created, maintained <br />and disposed of in accordance with this division or procedures authorized by this <br />division and in no other manner. <br />Department Director dead means the officer or employee who is in charge <br />of a department. who, by ,,,.dinanee, efde,. of „a,., inistfative pokey, ; in eharge 4 <br />an dministfative unit of the City that , eates or reeeives reeords. <br />Digital means when used in reference to a record, means the record is <br />maintained in an electronic data format that requires an electronic device to create, <br />store access retrieve or read the record. <br />
