ORDINANCE NO. 2020-43 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS RECLASSIFYING AND INCREASING THE RANK OF <br />THE FIREFIGHTER POSITION ASSIGNED TO THE FIRE <br />PREVENTION DIVISION, FROM THE RANK OF FIREFIGHTER TO <br />THE RANK OF ENGINEER IN ACCORDANCE WITH SECTION 143.021 <br />OF THE TEXAS LOCAL GOVERNMENT CODE; AMENDING THE FIRE <br />DEPARTMENT STAFFING TABLE MAINTAINED BY THE CITY <br />CLERK IN ACCORDANCE WITH SECTION 2.373 OF THE SAN <br />MARCOS CITY CODE TO REFLECT SUCH RECLASSIFICATION; <br />PROVIDING A SAVINGS CLAUSE; PROVIDING FOR THE REPEAL OF <br />ANY CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE <br />DATE. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. In accordance with Section 143.021 of the Texas Local Government Code, <br />the position of Firefighter assigned to the Fire Prevention Division is hereby reclassified and <br />increased to the rank of Engineer. <br />SECTION 2. The Fire Department Staffing Table maintained by the City Clerk in <br />accordance with Section 2.373 of the San Marcos City Code is amended as shown in Exhibit A, <br />attached hereto and made a part hereof, to reflect such reclassification. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 5. This ordinance will take effect after its passage, approval and adoption on <br />second reading. <br />PASSED AND APPROVED on first reading on June 2, 2020. <br />PASSED, APPROVED AND ADOPTED on second reading on June 16, 2020. <br />J in son <br />Mayor <br />
