ORDINANCE NO. 2020-84 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS REDUCING THE SPEED LIMIT FROM 30 MILES PER <br />HOUR TO 25 MILES PER HOUR IN PORTIONS OF SECTOR 1, <br />COMMONLY REFERRED TO AS THE HERITAGE AND DUNBAR <br />NEIGHBORHOODS; AUTHORIZING THE INSTALLATION OF SIGNS <br />AND TRAFFIC CONTROL DEVICES REFLECTING THE NEW SPEED <br />LIMITS; DIRECTING THAT THE TRAFFIC REGISTER MAINTAINED <br />UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE BE <br />AMENDED TO REFLECT THE NEW SPEED LIMITS; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. Pursuant to Chapter 82 of the San Marcos City Code, and on the basis of <br />finding that a decreased speed limit is reasonable and prudent, the speed limit in portions of Sector <br />1 commonly referred to as the Heritage and Dunbar Neighborhoods depicted on the map attached <br />hereto as Exhibit A are hereby decreased from 30 miles per hour to 25 miles per hour. <br />SECTION 2. The City's traffic engineer is authorized to install such signs and traffic <br />control devices as he deems appropriate to reflect the new speed limit. <br />SECTION 3. The traffic engineer is directed to amend the traffic register maintained <br />under section 82.067 of the San Marcos City Code to reflect the new speed limit. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 6. This ordinance shall be effective upon its adoption on second reading. <br />PASSED AND APPROVED on first reading November 17, 2020. <br />PASSED, APPROVED AND ADOPTED on second reading on December 2, 2020. <br />JaneHughson <br />Mayor <br />
