• RESOLUTION 2009-152R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE ACQUISITION OF A 0.129 <br />ACRE AND A 0.306 ACRE TRACT OF LAND, MORE OR LESS, OUT OF <br />AND PART OF THE CYRUS WICKSON SURVEY, ABSTRACT NO. 474, <br />HAYS COUNTY, TEXAS FOR PUBLIC RIGHT-OF-WAY AND OTHER <br />PUBLIC PURPOSES IN AN AMOUNT NOT TO EXCEED $110,000.00, <br />WHICH AMOUNT INCLUDES THE PURCHASE PRICE OF $98,000.00 <br />PLUS CLOSING COSTS; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE AN AGREEMENT WITH ELLEN JASTER, THE OWNER OF <br />SAID TRACTS OF LAND, PROVIDING FOR SUCH ACQUISITION; AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The acquisition of a 0.129 acre tract and a 0.306 acre tract of land out of and a <br />part of the Cyrus Wickson Survey, Abstract No. 474 (the "Land") as further described in the <br />agreement attached hereto (the "Agreement") is necessary for public right-of-way and other <br />public purposes. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />• TEXAS: <br />PART 1. The acquisition of the Land in an amount not to exceed $110,000.00 <br />which amount includes the purchase price of $98,000.00, plus closing costs, is hereby authorized <br />and approved. <br />PART 2. The terms and conditions of the Agreement between the City of San <br />Marcos and Ellen Jaster are hereby approved. <br />PART 3. The City Manager, Rick Menchaca, is authorized to execute the <br />Agreement and any related contracts and instruments necessary to consummate the acquisition of <br />the Land on behalf of the City. <br />PART 4. This Resolution shall be in full force and effect immediately from and <br />after its passage. <br />ADOPTED this the 20th day of October, 2009. <br />Susan Narvai <br />Mayor <br />
