<br />Consideration: Ten Dollars and other good and valuable consideration
<br />Property: Lots 1 through 4 of Block Number 73, and Lots 1 through 4 of Block Number 81,
<br />Section C of the Roselawn Addition to the San Marcos City Cemetery Grounds, according to the plat
<br />of such addition recorded in Book 11, Pages 57-58 of the Hays County Plat Records.
<br />The Grantor, for the consideration, has granted, sold and conveyed, and by these presents
<br />does grant, sell and convey unto Grantees, the property, to have and to hold the above described
<br />premises, together with all and singular the rights and appurtenances thereto in anywise belonging,
<br />unto the Grantees, Grantees' heirs and assigns forever. As a part of the consideration of the
<br />property conveyed, it is agreed and understood that the property shall be subject, always, to the
<br />restrictions imposed by the Governing body of said City of San Marcos in exercising Perpetual Care
<br />of the property. This provision is a covenant running with the land, binding upon the property, and
<br />the present and successive owners thereof, and inuring to the benefit of the Grantor, its successors
<br />and assigns, and to the benefit of the remaining lots in the cemetery, and the present and
<br />successive owners.
<br />Grantor makes this conveyance, and Grantees accept it, without any warranty as to the
<br />subsurface condition of the property, or the costs of making interments within the property. Grantees,
<br />and Grantees' successors and assigns, accept all risks as to such conditions and costs as a part
<br />of this transaction.
<br />This deed supersedes 1) the Pennington Funeral Home deed, dated December 14, 1970
<br />from Bill Johnson to Reagan and Lee Gary for Lots 1 through 8 of Block 44, Section B, Roselawn
<br />Addition of the San Marcos Cemetery as recorded in Volume 1514, Page 420 of the Official Records
<br />for Hays County, Texas, and 2) an unrecorded deed, dated January 8, 1971 from Bill Johnson to
<br />Reagan and Lee Gary for Lots 1 through 8 of Block 55, Section B, Roselawn Addition of the San
<br />Marcos Cemetery. The tracts covered by these deeds have been conveyed to other individuals, and
<br />the deeds for those conveyances have been recorded. This deed is made by Grantor and accepted
<br />by Grantees in complete substitution for the two deeds described above, so that the Grantees shall
<br />have and claim no further right, title, or interest in or to the tracts described in the two deeds stated
<br />above in this paragraph.
<br />This deed is executed on behalf of Grantor by its Mayor, and attested by its Secretary, as
<br />authorized by an ordinance passed on August 6, 1924 of record in Volume 6, at page 154, in the
<br />official minutes of Grantor's City Commission, this the 1 qday of May, 2003.
