ORDINANCE NO. 2022-15 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE INSTALLATION OF SPEED CUSHIONS IN BOTH DIRECTIONS IN THE 500 THROUGH 1200 BLOCKS OF FRANKLIN DRIVE (FROM OLD RANCH ROAD 12 TO BISHOP STREET); AND INCLUDING PROCEDURAL PROVISIONS. RECITALS: 1. Franklin Drive is a two-way residential street. A traffic study indicates that the 85th percentile speed in the 500 to 1200 blocks of Franklin Drive is 37.5 miles per hour at Furman Avenue and 34.6 miles per hour at Stokes Street, both of which are in excess of the posted speed limit of 25 miles per hour. 2. Such traffic conditions are not safe for residents and residents have petitioned the City to install speed cushions on said blocks of Franklin Drive. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Recitals are hereby found to be true and correct and are adopted as the findings of the City Council. SECTION 2. Pursuant to Section 82.066 of the San Marcos Code, on the basis of such findings, the City Council hereby authorizes the installation of speed cushions in the 500 to 1200 blocks of Franklin Drive (from Old Ranch Road 12 to Bishop Street). SECTION 3. The installation of signs providing notice of the presence of the speed cushions is also hereby authorized. SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 5. All ordinances and resolutions or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 6. This ordinance shall be effective upon its adoption on second reading. PASSED AND APPROVED on first reading on February 15, 2022. PASSED, APPROVED AND ADOPTED on second reading on March 1, 2022.
