RESOLUTION NO. 2022-237R <br /> CONSIDER APPROVAL OF RESOLUTION NO. 2022-237R APPROVING THE <br /> ALLIANCE REGIONAL WATER AUTHORITY (ARWA) ISSUING CONTRACT <br /> REVENUE BONDS FOR THE CITY OF SAN MARCOS IN THE AGGREGATE <br /> PRINCIPAL AMOUNT OF$17,210,000 INCLUDING APPROVAL OF THE BOND <br /> RESOLUTION AND OTHER RELATED MATTERS IN ACCORDANCE WITH THE <br /> REGIONAL WATER SUPPLY CONTRACT <br /> CITY OF SAN MARCOS § <br /> COUNTIES OF HAYS, CALDWELL AND GUADALUPE § <br /> STATE OF TEXAS § <br /> WHEREAS, the City of San Marcos, Texas (the "City") is a sponsor of the Alliance <br /> Regional Water Authority(the "Authority"); and <br /> WHEREAS, the City has approved and executed the Regional Water Supply Contract <br /> dated and effective January 9, 2008 for the financing, construction and operation of the Authority <br /> Regional Water Supply Project as amended by Amendment No. 1 to the Contract(collectively,the <br /> "Contract"); and <br /> WHEREAS, the City has previously requested the Authority issue a separate series of <br /> contract revenue bonds for the City in an amount not to exceed $17,210,000 entitled "Alliance <br /> Regional Water Authority Contract Revenue Bonds (Regional Water Supply Contract Project— <br /> City of San Marcos,Texas), Series 2022C" (the "Bonds")to finance the City's contribution to the <br /> design,construction and equipment of the Phase 1B Improvements of the Authority Water Supply <br /> Project pursuant to the Contract which Bonds are payable from the Bond Payments to be made to <br /> the Authority under and pursuant to the Contract; and <br /> WHEREAS, pursuant to Section 3.1(c) of the Contract, prior to adoption of a bond <br /> resolution for the City by the Authority's Board of Directors,a substantially final copy of the Bond <br /> Resolution for the City and the sale and offering documents, if any, shall be presented to the City <br /> for review and approval; and <br /> WHEREAS, a substantially final copy of the Authority's Bond Resolution, as defined in <br /> the Contract, authorizing the Bonds for the City's share of the Phase 1B Improvements of the <br /> Authority Water Supply Project has been presented to the City for review and approval; and <br /> WHEREAS, the Bonds are being sold to the Texas Water Development Board and there <br /> are no sale and offering documents, as defined in the Contract, to be presented to the City for <br /> review and approval; however, a private placement memorandum has been submitted to the City <br /> for review and approval; and <br /> WHEREAS, it is hereby further officially found and determined that public notice of the <br /> time, place, and purpose of this meeting was given, all as required by Texas Government Code, <br /> Chapter 551. <br /> ARWA SM 22C:Res Approving Res <br />
