RESOLUTION NO. 2023-71R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AUTHORIZING THE SUBMISSION OF FOUR <br /> SUBDIVISION SETTLEMENT PARTICIPATION FORMS TO THE <br /> OFFICE OF THE ATTORNEY GENERAL OF THE STATE OF TEXAS TO <br /> SECURE THE CITY'S PARTICIPATION IN SETTLEMENT OF <br /> ADDITIONAL CLASS ACTION LAWSUITS AGAINST OPIOID <br /> DISTRIBUTERS AND MANUFACTURERS, ALLERGAN, CVS, <br /> WALGREENS, AND WALMART, BEFORE THE DEADLINE OF APRIL <br /> 18,2023;AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO <br /> EXECUTE ALL DOCUMENTS NECESSARY FOR THE CITY TO <br /> PARTICIPATE IN THE SETTLEMENT; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council of the City of San Marcos previously approved the City's <br /> participation in certain initial settlements related to opioid abatement pursued by the Texas Attorney <br /> General's Office(AG). On December 15,2021,the City approved Resolution 2021-261R authorizing <br /> the submission of a subdivision settlement participation form to the AG to secure the City's <br /> participation in a class action lawsuit against multiple opioid distributors and manufacturers. <br /> 2. Since approval of the initial Resolution, the AG has announced four additional <br /> settlements pending court approval. These new settlements require their own subdivision <br /> participation forms signed by the City Manager. The purpose of this resolution is to grant signature <br /> authorization for these new forms. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. The City Council of the City of San Marcos authorizes the submission to <br /> the Office of the Attorney General of the State of Texas of four subdivision settlement participation <br /> forms in the format attached hereto,to secure the City's participation in lawsuits and settlements of <br /> additional class action lawsuits against Opioid distributors and manufacturers known as Allergan, <br /> CVS, Walgreens, and Walmart. <br /> PART 2. The City Manager or her designee is authorized to execute all documents <br /> necessary related to participating in the lawsuits and the four settlements on behalf of the City. <br /> PART 3. This resolution shall become effective immediately from and after its <br /> passage. <br /> ADOPTED on April 4, 2023. <br />
