ORDINANCE NO. 2022-96 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AMENDING CHAPTER 6, ANIMALS, OF THE SAN <br /> MARCOS CITY .CODE TO AMEND DEFINITIONS, DELEGATE <br /> AUTHORITY FOR DEPARTMENT TO WAIVE OR REDUCE FEES, <br /> LIMIT REASONS TO IMPOUND CATS, DELETE STRAY HOLD <br /> REQUIREMENT IN SOME INSTANCES, INCLUDE STRICTER <br /> REQUIREMENTS FOR SPAY/NEUTER AND MICROCHIPPING, <br /> CREATE AN OFFENSE FOR FAILURE TO RECLAIM OR SURRENDER <br /> PET UPON NOTICE, ADD REQUIREMENTS FOR PET SHOPS/PET <br /> STORES, INCLUDING REGULATION OF SOURCE OF PETS; AND <br /> PROVIDE FOR PERMITTING AND INSPECTIONS; REPEALING ANY <br /> CONFLICTING PROVISIONS; AND PROVIDING AN EFFECTIVE <br /> DATE. <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> SECTION 1. Chapter 6, Animals, of the San Marcos City Code is hereby amended to <br /> read as set forth in the document attached hereto and incorporated herein as Exhibit "A" (added <br /> language is underlined, deleted text is indicated by strikethrough). <br /> SECTION 2. If any word,phrase, clause, sentence, or paragraph of this ordinance is held <br /> to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br /> ordinance will continue in force if they can be given effect without the invalid portion. <br /> SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 4. This ordinance will take effect after its passage, approval and adoption on <br /> second reading,provided however, that Section 6.065, subsection c, prohibiting pet stores and pet <br /> shops from offering for sale dogs or cats obtained from sources other than a city or county animal <br /> shelter, animal control agency, or animal welfare organization licensed by the city, shall become <br /> effective on March 21, 2024. <br /> PASSED AND APPROVED on first reading on March 7, 2023. <br /> PASSED,APPROVED AND ADOPTED on second reading on March 21, 2023. <br /> Jane Hughson <br /> Mayor <br />
